Well, if you're like Joyce, a 59-year-old mother of two from central California, you search the internet for a solution that won't betray your religious convictions (or at least not much) and that won't offend your sensibilities—and you find one at Book22.com, named after the book in the Bible that contains the Song of Solomon, considered by many to be the raciest part of that tome.

"We avoid any objectionable wording or pictures in the line of products we offer," notes a statement on the site's home page. "Your privacy and protection are important to us. You will not receive anything but what you have ordered. We will not send out unsolicited e-mail or any other material to you. Your information will not be sold or given out to anyone by our company. All products are sold as a novelty only, this is to protect our customers who live in states that do not allow the sale of intimacy products, for personal use."

Members of the adult industry might find it hard to believe that some folks are so screwed up (well, or shy) that they can't bring themselves to go down to the local adult boutique and pick out the toy that they think stands the best chance of getting them off, or even to go to one of the many adult sites that offer similar gadgetry, but according to an article by Daily Beast writer Allison Yarrow, it's a lot more common than even one might fear.

"To an outsider, visiting the religious sites feels a bit like listening to the bleeped-out version of an explicit hip-hop song: the substance is the same, it's just missing the X-rated details," Yarrow wrote. "None of the sites feature any nudity, instead relying on mannequins to display lingerie. Nor do they feature any sexy language. Kosher Sex Toys, for example, rewrites product descriptions that risk shocking its audience. (The 'Butterfly Clitoris Stimulator' becomes, simply, the 'Vibrating Stimulator.') And while they don't flaunt their holiness, they'll occasionally rely on religious messaging to sell themselves, or perhaps put potential customers at ease. Book 22, for example, promises to 'enhance the intimate life of all God's children'."

Shades of Hysteria!

Indeed; the Book 22 site doesn't even list "vibrator" in its menu; you have to click on the button that says simply "waterproof." Indeed; everything they sell is repackaged into plain boxes, while another site, El Asira, run by a practicing Muslim, "only stocks brands that arrive in tasteful and inoffensive wrappings"—and are "Sharia-compliant." Book 22 also has "intimacy kits" available; the one labeled "Newlywed Kit" (pictured) contains a copy of the pamphlet "What's Okay & What's Not" by Paul & Lori Bylerly, a Pillow Pack ID Pleasure Lube, a Pillow Pack ID Flavored Lube, a Pillow Pack Essence of Pearl Lotion, a Pillow Pack Silicone Lube,  Pleasure Feather massager, a Silky Black Storage Bag, 2 oz. of tropical-scented massage cream, a plastic handheld massager, two tea lights, and a Mini-Massage Guide.

The article, which novelty manufacturers would certainly find well worth reading, discusses the various conflicts that can arise between religious dogma and adherents' need for sexual outlets—while others might just want to check it out for kicks, or to laugh at how screwed up orthodox religiosity can make some people.

But one thing's for sure: No matter how religious you are, there are still places on the internet where your needs can be satisfied while not offending your sensibilities.

LOS ANGELES—Those who caught 'The Last Word' with Lawrence O'Donnell last night on MSNBC would have been treated to a five-minute segment of political humor... if the topic hadn't been of such overwhelming importance to the adult industry.

Everyone knows that every single top Republican presidential candidate is a hypocrite, whether it's Newt Gingrich's history of extramarital philandering, or Mitt Romney's impressive list of flip-flops, or Ron Paul's attempts to erase his history of racism, or Michelle Bachmann's dismissal of the usefulness of Medicaid until she found out her husband's clinic received Medicaid funds, or Rick Santorum comparing gay marriage to "man on dog" sex, or Rick Perry, who's rumored to have had gay liaisons, forgetting his Supreme Court fight to keep homosexuality illegal in Lawrence v. Texas as well as claiming there's some connection between gays in the military and banning official prayer in schools, or Jon Huntsman, who's decided that maybe global climate change doesn't really have a scientific basis after all.

Bearing all that in mind, it's perhaps not surprising that O'Donnell would call out the Republican candidates in general, and Newt Gingrich in particular, to oppose the upcoming vote on whether to force all adult performers in Los Angeles to wear condoms while performing sex scenes.

After noting that Gingrich somehow couldn't get 10,000 of Virginia's 8 million residents to sign his petition to be placed on that state's commonwealth's presidential primary ballot, O'Donnell continued, "The city where I am now, Los Angeles, has a population about half the state of Virginia, and the people of Los Angeles produced 70,000 signatures—30,000 more than needed—to put a measure on the presidential primary ballot that would require actors in porn to wear condoms while filming in the city of Los Angeles. There is no clearer marker of the depths that the Gingrich campaign has sunk to than the fact that there are more people who want to protect the health of porn stars than there are people in the entire state of Virginia who want the chance to vote for Newt Gingrich for President."

But making that comparison seemed to inspire O'Donnell to further "heights":

 "[I]f at least two candidates are left standing when the Republican campaign comes to California, the very first question I want to hear asked at the debate is, 'Are you in favor of porn stars being required to wear condoms?'" he implored. "There is no better trick question for the Republican candidates! These are the candidates who swear that the only greater evil than government regulation is of course taxation, and the measure that will be on the ballot in California with those Republican candidates not only calls for regulating the wardrobes in porn films, but it imposes a fee—really, it's a tax, really; it's really a tax—on porn producers to pay for government inspection of porn film sets to make sure the actors are complying with the new government regulation. Porn producers hate this thing. You would think anything that's bad for the porn business is something prudish Republican candidates would want to—I'm not gonna say 'get behind.'"

"The problem for Republicans is that this is classic liberal big government imposition of regulation and taxation on small businesses that Republicans swear to us are already overregulated and overtaxed," he continued, "and it creates a new kind of government worker whose salary and benefits Republicans would always being trying to cut: Porn set condom inspectors. Now, we know there is only one Republican candidate who would have no problem with this question in a California debate: Ron Paul would be vehemently opposed to the regulation and taxation of porn producers to pay for that regulation. But where do the rest of the Republican candidates go on this one? Do they choose to make life tougher for porn producers? Do they side with the AIDS Health [sic] Foundation that got the signatures to put this proposition on the ballot? Do they rewrite their anti-regulation, anti-tax stance to include exceptions for porn producers? Do they oppose the tax on porn producers because, as they always say, government already taxes small business way too much in this country? Or do they just stick with their principles, stick with their anti-tax, anti-regulation principles and stand side by side with porn producers in the principled fight against condoms on porn sets?"

O'Donnell closed the segment by suggesting that if the Republicans actually adopted the anti-AIDS Healthcare position, they might actually find themselves the recipients of campaign contributions from at least one porn studio, because "Steven Hirsch... can pour more money into your campaign than you can count." Why? Because "[t]he only people who hate regulation even a little bit more than Republican presidential candidates are porn producers."

Of course, porn producers don't "hate regulation," unless those regulations are designed to put them out of business, as mandatory condoms (and the dental dams, goggles and face shields that would inevitably follow) likely would—but the key here is that O'Donnell has set the porn industry up as the "bad guys" who are so against performer health and safety that logically, even those other bad guys, the Republican presidential candidates, should support them—and would, if they weren't all hypocrites. And that's a piss-poor message for a putative liberal to be delivering on national TV.

In a sense, the situation is similar to the misunderstanding by at least one adult commentator of the amendment suggested by Rep. Zoe Lofgren (D-CA) but offered by Rep. Jared Polis (D-CO) to the Stop Online Piracy Act (SOPA) which would have exempted the adult industry—certainly the world's biggest victim of online piracy—from availing themselves of the government's resources to protect their intellectual property rights because those properties "are pornographic or obscene in nature"—and of course, Congress couldn't be seen as doing anything that in any way helps the porn industry. Still, they voted the amendment down—but a Polis spokesperson nonetheless told the Huffington Post that, "You're basically going to have the Justice Department policing all of this, and if we're going to be extending those resources, we shouldn't be prioritizing the property rights of pornographers over others."

Yeah! No special government privileges for pornographers—even if they never asked for any, and nothing in the bill gives them any.

Or as Tom Hymes noted in his article, "In combining pornography and obscenity, which Polis did as well in his amendment, the lawmakers do disservice to the First Amendment despite their acknowledgment that people have the constitutional right to make and access legal porn. The constitution means little, however, if legislators can so easily conflate illegal and legal acts, and in doing so drag the latter down to the same level as the former."

And the football season is only just getting under way!

PARIS, France—In a move that may affect some adult performers both in the U.S. and in Europe, French Health Minister Xavier Bertrand this week ordered his country's national health care system to pay for the replacement of approximately 30,000 breast implants which used materials made by French firm Poly Implant Prothese (PIP), after it was learned that the implants contained industrial-grade rather than medical-grade silicone, and that their casings were faulty and prone to rupture or leakage.

"I've always suffered from depression and mental-health problems linked to body image," said an unidentified 48-year-old woman from Normandy. "I earn €1,000 [$1,298] a month in a factory. I couldn't afford breast surgery until my late 40s. But after the implants I felt better, I came off the antidepressants, I was able to face work. Then I find out the implants are poison. The tests say they're still in place but I'm having them removed anyway. I'm terrified they'll rupture or explode at any moment ... I go to bed feeling bad, I wake up feeling bad. It's like living with a ticking bomb inside you."

According to The Guardian (UK), a crowd of angry women demonstrated outside the French health ministry shouting, "We want justice!" And the BBC News reported that police have received more than 2,000 complaints from women who received the implants, and France's Director-General for Health Jean-Yves Grall stated that eight cases of cancer had been reported this year by women who had received the PIP implants.

"The implant had leaked to such an extent I had four swellings hanging from my armpits which were full of silicone gel, and had to be drained," said Sylvie, 57, who once ran a children's clothing business outside Paris and received PIP implants seven years ago after reconstruction surgery following breast cancer. "Last year I found out the implants were defective but I was having chemotherapy at the time so I couldn't have them removed immediately. It's as if a foreign element is poisoning your body as well as the cancer. If you think about it too much, you'd suffocate. You have to have a mentality of steel to survive."

"Flat-chested, I never felt like a woman," said Audrey, 32, a child care provider from southern France. "After the implants, I felt transformed. When I saw the TV reports of faulty implants, I went to have them removed. Tests had shown mine had not ruptured or leaked, but during surgery the doctor found they were in fact leaking ... I breastfed for eight months with these implants in place—at what risk to my child?"

Dozens of British women have already sued the company over the faulty implants, and Interpol has issued an arrest warrant for PIP founder Jean-Claude Mas ... for drunk-driving in Costa Rica.

"He was a butcher, selling ham and sausage, before he started this line of work," said a former associate of Mas's.

An estimated 21,000 implant surgeries are performed each year in France.

DETROIT—A series of horrific murders in Detroit may be the work of a serial killer targeting escorts by way of Backpage.com, the online classifieds service owned by Village Voice Media that has steadfastly resisted efforts by clergy and law enforcement officials to get it to close its adult services section.

Police confirmed Monday that three of the four women found burned beyond recognition in the trunk of cars were linked to sex-related ads on Backpage.com that "specifically dealt with prearranged adult dating services.”

Adding to the unsolved mystery, the women were found in pairs. According to the Detroit Free Press, “Demesha Hunt, 24, and Renisha Landers, 23, both of Detroit, were discovered about 3 p.m. Dec. 19 in the trunk of a 2009 Chrysler 300C on the 14900 block of Promenade.

“Two more women, their names not yet released by police, were found burned beyond recognition about 1 a.m. Sunday in the trunk of a 1997 Buick LeSabre parked in a garage on the 14900 block of Lannette, according to [Detroit Police Chief Ralph] Godbee. They were 28 and 29,” the article continued.

Though Godbee was not prepared to state that the killings are the work of a serial killer, or that whoever was responsible used Backpage.com as a method of introduction, he did say during a news conference Monday, “With the vast increase in the utilization of social media and the internet, we must continue to be vigilant in identifying any website which may potentially pose a threat to individuals.”

Tuesday, Backpage.com legal counsel Steve Suskin issued a statement in response to the Detroit killings, which is reprinted below in its entirety:

After we heard about these terrible crimes, we reached out to the Detroit Police Department, even before we heard from them, to offer assistance in the investigation. BENSALEM, Pa.—The Superior Court of Pennsylvania has overturned the 2010 attempted prostitution conviction of Susan Finkelstein, the 45-year old married woman who placed an ad on Cragislist in 2009 saying she was desperate for tickets to see her Philadelphia Phillies in that season’s World Series, and was subsequently arrested by undercover officers after arranging to meet a man with whom she allegedly agreed to have sex in exchange for tickets to see the Phillies play the Yankees. The Yankees eventually beat the Phillies 4-2.

The Craigslist ad placed by Finkelstein made no mention of sex, but could have been interpreted as implying something naughty. It read:

"DESPERATE BLOND (sic) NEEDS WS TIX (Philadelphia). Diehard Phillies fan—gorgeous tall buxom blonde—in desperate need of two World Series Tickets. Price negotiable—I'm the creative type! Maybe we can help each other! S."

As AVN reported at the time, the police noticed the ad and decided to contact the woman and set up a sting operation.

“Police said Finkelstein didn't particularly look like a diehard Phillies fan when she met them, lacking the typical Phillies regalia,” reported a local paper. “And she wasn't chit-chatty about baseball, offering no predictions on tonight's pitching duel between Cliff Lee and CC Sabathia or anything else.”

According to the police report and subsequent testimony, however, Finkelstein “told the officer that she was willing to have sex for the tickets, including anal sex, and that she would do anything for a second ticket, including having sex with the officer’s brother, in exchange for his second ticket or having sex with both of them simultaneously.

“Defendant then proposed going to the brother’s house, where the exchange could occur. Defendant punctuated the proposal by spreading her legs, allowing [Sergeant Bugsch] to look under her skirt, where she was not wearing underwear. She then asked the officer ‘if he wants to touch it.’

“[Sergeant Bugsch] told Defendant to wait while he called his brother to see if he was interested. Instead, he contacted the other observing officers, who then arrested Defendant for prostitution.”

Finkelstein denied that account of the meeting but a jury nonetheless found her guilty of attempted prostitution in March 2010 and she was sentenced to a year of probation and 100 hours of community service. She appealed, and Tuesday, the Superior Court agreed with the facts of the case as alleged above, but overturned the conviction anyway, finding that Finkelstein’s attempt to exchange sex for World Series tickets did not meet the requirements of Pennsylvania’s law against prostitution, which defines prostitution as, in part:

§ 5902. Prostitution and related offenses

(a) Prostitution. A person is guilty of prostitution if he or she:

(1) is an inmate of a house of prostitution or otherwise engages in sexual activity as a business; or

(2) loiters in or within view of any public place for the purpose of being hired to engage in sexual activity.

“Thus,” the court reasoned, “a person might be said to have attempted prostitution if she took a substantial step toward engaging in sexual activity as a business. In this case, that step consisted of Finkelstein’s offer to engage in sex as payment for baseball tickets; the record offers no evidence of other conduct.”

Considering the totality of the facts presented to it, the court determined that Finkelstein’s actions, even if they happened exactly as alleged by the police, did not constitute a business.

“Our cases have made clear that the conduct in which Finkelstein engaged here does not fall within the ambit of Prostitution and, consequently, cannot be the subject of an Attempt conviction,” the opinion read, adding, “This Court has acknowledged that the Crimes Code’s prohibition of Prostitution is marked by a lack of precision, as a consequence of which its application has been subject to ‘common understanding and practice.’”

The opinion continued, “We have recognized accordingly that ‘the gravamen of the offense is not the sexual activity itself but the business of engaging in such activity for hire.’ (Commonwealth v. Danko) Thus, neither promiscuity and its moral implications, nor the sex act itself offer grounds for arrest and conviction.”

The opinion concluded, “The legislative objective in criminalizing prostitution is not to criminalize ‘private illicit sexual relations,’ but rather to curtail the deleterious effect of an open commercial sex trade on public health and law enforcement, as well as to avoid the exploitation of women. None of the evidence in this case implicates these concerns and Finkelstein’s conduct did not exceed the ambit of ‘private illicit sexual relations.’ Indeed, Susan Finkelstein appears as the embodiment of ‘a girl not generally engaged in commercial activity [who] nevertheless consents to have intercourse on a particular occasion in exchange for a promised reward.’ Under these circumstances, we conclude the Susan Finkelstein’s conviction of Attempt exceeds the lawful scope of our statutory prohibition of Prostitution and cannot be sustained.”

We can’t confirm the following, but rumor has it Finkelstein and her husband, who ended up seeing game 3 of the 2009 Series courtesy of a local radio station, are also mad fans of ColdPlay, which is performing at the Wells Fargo Center in Philadelphia July 5, 2012. It’s a ways off, but if anyone has any tickets they want to legally exchange for sex…

ENCINO, Calif.—We know of only one attorney who has the First Amendment tattooed around his upper arm: Allan B. Gelbard, Esq. So it's only fitting that he, in conjunction with the First Amendment Lawyers Association (FALA), is planning to teach members of the protest movement Occupy LA a short course in the First Amendment, hopefully to keep them out of city jail.

As most LA residents probably know by now, the City of Los Angeles has had a sort of indifference/hate relationship with the local branch of the Occupy movement, with the city alternately affirming that it will take no action against Occupy encampments, and then later busting them anyway.

So far, according to an article in today's Los Angeles Times, more than 350 Occupy protesters have been arrested since their encampment began back in October, and in a new move, the City Attorney's office has agreed not to push for fines and/or jail sentences for the defendants if they'll be willing to pay $355 to a private corporation, American Justice Associates, to take a course in "free speech" consisting of lectures given by attorneys and retired judges—just the sort of people who can be counted on to give an unbiased view of citizens' First Amendment rights to, for instance, assemble peaceably and petition the government for redress of grievances.

Only those with no previous criminal record and who were arrested for "low-level misdemeanor offenses, such as failure to disperse," are eligible to have their charges dropped in exchange for attending the course... but Gelbard sees a gaping hole or two in the City Attorney's plan.

"While I applaud the City Attorney’s office for now offering many purported offenders an opportunity to participate in a diversion program involving a First Amendment education, and thereby to avoid criminal prosecution, it appears that there are several obvious problems in the manner in which this program is to be conducted," Gelbard wrote in a letter to LA City Attorney Carmen Trutanich.

"Initially, I am concerned that many of the Occupy protestors may not have the funds necessary to attend such a class," Gelbard stated. "As part of Occupy’s core mission is to raise awareness of the income diversity between the classes, it would seem cruelly ironic to prevent members from participating in a First Amendment education—and contemporaneously avoiding a criminal prosecution—should they simply be financially incapable of paying for the class.

"Second, and more importantly from a First Amendment prospective, requiring these individuals to pay money to a corporate provider appears to force them to sacrifice adherence to a core political belief—refusing to contribute to funding of the increasingly improper power of corporate interests—in exchange for government favor (dismissal of their criminal cases), a choice that is, in and of itself, prohibited by the First Amendment," Gelbard advised, citing several U.S. Supreme Court decisions affirming that government may not condition citizens' First Amendment rights on their being forced to pay for some government or corporate service—like $355 for so-called "First Amendment lessons."

But Gelbard thinks he has a solution.

"My office, working in conjunction with the First Amendment Lawyer’s Association, will provide the First Amendment class to all who wish to attend—at no cost to the defendants or the city," Gelbard offered. "We will provide all appropriate record-keeping to verify individual attendance, all written materials, the participation of myself and several other nationally respected First Amendment practitioners, the curriculum, and all necessary administrative and logistical services, at no charge to either the City or the Occupy defendants.

"We intend to hold this class in a public location," he added, "so that all others who wish to audit the class (subject of course to space restrictions) and learn about the protections of the First Amendment—including the Mayor, city counsel members and police officers—will be free to do so."

And if there's one thing Gelbard and other members of FALA know, it's First Amendment law!

So when Chief Deputy City Attorney William Carter is quoted by the LA Times as saying, "The 1st Amendment is not absolute," noting that "the U.S. Supreme Court has ruled government can regulate when, where and how free speech can be exercised," he's talking about City of Renton v. Playtime Theatres—a case with which FALA members are intimately familiar. And considering how often government attorneys at all levels seem to have forgotten what they learned in their Constitutional Law 101 classes, perhaps courses in what the First Amendment really means would be better taught by those whose salaries aren't paid with green checks.

"I look forward to discussing this proposal with you at your earliest convenience," Gelbard concludes—and we can all hope that Mr. Trutanich, who's shown such common sense in filing a lawsuit against AIDS Healthcare Foundation's "condoms in porn" power grab, will consider Gelbard's proposal with an open mind.

CHARLESTON, S.C.—A Georgia man has sued South Carolina military college The Citadel and a former cadet of the school, Andrew Smith, accusing the institution and the individual with gross negligence after his 17-year-old daughter’s name and mobile telephone number were allegedly posted to a porn site by the cadet. The lawsuit, which was filed Dec. 14 on behalf of Randy Upton and his daughter, Kelsey Upton, also accuses Smith of invasion of privacy and defamation.

“According to the suit, Smith posted the name and contact information of Upton's daughter next to a photo of a naked woman on the website sextingpics.com,” reported a local ABC News affiliate. “Upton's daughter appeared before The Citadel Commandant's Board on March 21, 2011. At that meeting, the suit makes note that Andrew Smith apologized for his action.”

The school apparently disciplined Smith, but was unable to say what the punishment was because of privacy provisions contained in the Family Education Rights and Privacy Act (FERPA), but a lawyer for the school, Dawes Cooke said it cooperated completely with the family and could only state that the Smith was no longer enrolled at The Citadel.

"They (The Citadel) did take appropriate action," he said, adding that the institution would defend itself rigorously in court.

The action by Smith has had serious repercussions for his daughter, said Upton, who alleges that the family learned the placement of Kelsey's name and number on the site next to a photo of a naked woman who resembled her when a 55-year-old man from Iowa later sent her a text message.

“Since November 15, 2010,” the complaint reads, “-------- and her family have been living in fear that has consumed her life and destroyed her sense of safety within her home, her community and society at large. This fear is directly attributable to defendant Smith's placement of -------- personal information on a pornographic website and defendant Citadel's failure to take any steps to ensure such placement could not, or would not happen."

Upton, a former investigator with the Georgia Bureau of Investigation, and his daughter are now working to make it a crime in the state to place personal information about a minor on a porn site.

The site in question contains a 2257 link that states, “All models, actors, actresses and other persons that appear in any visual depiction of actual sexually explicit conduct appearing or otherwise contained in this Website were over the age of eighteen years at the time of the creation of such depictions.”

MOBILESPACE—Research in Motion has promised to introduce new parental control features in future versions of the operating systems used in its Blackberry smartphones after being called in earlier this week to discuss its filtering deficiencies with U.K. telecom regulator OFCOM. The Canadian company was calling by OFCOM after complaints were received that minors could access porn on Blackberries because the phones lack parental controls that can be controlled by mobile operators.

In the aftermath of the meeting, according to Mobile magazine, RIM said it “plans to provide integrated parental control features in future versions of its BlackBerry 7 OS in order to allow parents to control various settings on their child's smartphone including the browser, text messaging and access to social networking sites.”

In addition, the company said BlackBerry App World 3.1 will now offer content rating and filtering options for applications based on the CTIA Wireless Association’s Guidelines for App Content Classification and Ratings.

A RIM spokesperson commented, “RIM is committed to child protection and is an active member of the [U.K.-based] Internet Watch Foundation (IWF). Access to IWF URLs [is] blocked on BlackBerry in the UK and this is being put in place in the international markets in which BlackBerry is available. 

“In addition,” the spokesperson continued, “as a provider to mobile operators, RIM fully supports its operator partners around the world in meeting obligations and commitments in this important area. Content filtering support is available to operators from RIM that enables the operator to perform the content filtering function for BlackBerry smartphones.”

LOS ANGELES—A curious posting showed up on the Los Angeles Times' website today. Titled "Condoms in porn? What should we do?" by "The Times' Opinion staff," it asks for public comment regarding what position the Board should take on the ballot initiative by AIDS Healthcare Foundation (AHF) that would require FilmLA, the agency that issues filming permits in the city, to withhold permits for adult producers unless they agree to the following language in the permit contract: "Permittee must abide by all applicable workplace health and safety regulations, including California Code of Regulations Title 8, Section 5193, which mandates barrier protection, including condoms, to shield performers from contact with blood or other potentially infectious material during the production of films."

What's most amazing, of course, is that for the last 18 months or so, every single article written by a Times reporter has championed AHF's mandatory condom (and other "barrier protection") stance, even to the point of unquestioningly accepting bogus claims of HIV infections in the industry, unquestioningly accepting LA County Department of Public Health statistics on infection rates—statistics that were shown to be inaccurate by epidemiologist Dr. Lawrence S. Mayer— and rarely giving knowledgeable adult industry spokespeople a chance to respond to AHF's lies.

The Times' Opinion staff, after acknowledging that it editorialized more than a year ago that "it may be time... to change" the law to specifically require that condoms be used in adult productions, now says that with the introduction of the AHF initiative, things are different.

"But now we're dealing with a more complicated question: Should the city of Los Angeles adopt a condom mandate as part of its power to issue or deny permits for film shoots?" the Times' Opinion staff writes. "Should voters be allowed to adopt such a mandate into law? Should the city attorney go ahead with a lawsuit to block an initiative to require condoms in porn shoots if his lawyers firmly believe that such a law is unenforceable—because it's arguably in conflict with the California Division of Occupational Safety and Health (Cal/OSHA) jurisdiction over workplace safety? What about if going ahead with the arguably unenforceable election will cost the city $4.4 million?"

All good questions—and one has to wonder why the Times is asking them now... unless the Editorial Board sees a possible impact of the initiative on mainstream film and TV production? That despite the fact that the title of AHF's petition is "City of Los Angeles Safer Sex in the Adult Film Industry Act"—but who knows what future ramifications there could be if FilmLA is given responsibilities to act as some sort of "adult industry health czar"?

Of course, in its quest for public comments on AHF's petition, the Editorial Board provides some interesting statistics regarding the initiative.

"The [petition signature] verification process costs the city $372,000," the article notes. "The initiative would have to go on the next available ballot—the June 5, 2012, presidential primary. That's not a city election, so the measure would have to hitchhike on a county ballot, and that's not cheap: It will cost $4.4 million."

Los Angeles taxpayers should definitely be asking themselves, in these budget-strapped days when teachers, firefighters and other valuable public officials are losing their jobs, if they want to be on the hook for a minimum cost of $4.4 million to enact AHF's latest attempt to destroy the (massively taxpaying) adult industry in Los Angeles—and of course, that $4.4 million figure doesn't include the costs of the several lawsuits that are sure to be filed against the initiative by adult producers.

"But City Atty. Carmen Trutanich's lawyers believe there's a good chance that the initiative, if adopted, would be struck down as being outside the city's jurisdiction," the article goes on to note. "Only Cal/OSHA, they say, can regulate workplace safety."

Indeed, as AVN noted, Trutanich filed a lawsuit December 8 to prevent the AHF initiative from appearing on the ballot, and on December 13, City Councilmen Bill Rosendahl and Paul Koretz introduced an emergency motion before the Council to withdraw that lawsuit. But although the City Clerk's website indicates that a vote on that motion was taken and was unanimously approved by the 11 councilmembers present, the Times story states that the motion had in fact been tabled, perhaps until the City Clerk actually verifies that AHF has gathered enough valid signatures, which must occur by December 23.

And Trutanich's point, as previously noted, is a valid one. Although AHF managed to produce a July 20 letter from CalOSHA staff attorney James D. Clark which AHF claimed supported its position, in fact the letter does exactly the opposite.

"It is [CalOSHA's] position that State law does not preempt such action by the City because the City does not seek to enact an occupational health and safety standard but rather a public health standard applicable to any film activity (regardless of employment relationship) within the City Boundaries," Clark states in the section titled "Conclusion."

Of course, over the course of more than 18 months of hearings before CalOSHA Chief Inspector Deborah Gold, all of the CalOSHA employees present at the hearings, including counsel Amy Martin, have maintained that requiring condoms and other barrier protection on porn sets is exactly an "occupational health and safety standard"—specifically, the very standard AHF claims its initiative would enforce: California Code of Regulations, Title 8 §5193—and that it considers all adult performers to be employees of production companies.

Clark's twisted analysis of the then-impending AHF proposal actually claims that requiring condoms in porn is more akin to, say, building a residence in an industrial area; in other words, a zoning issue rather than a health one.

"This permit is, in essence, an exception to, or variance from, existing zoning ordinances that prohibit filming in the City except on a sound stage," Clark writes. "In that respect, the potential City action would be zoning in nature... The City's remedy for violating any of the conditions would be revocation on the permit."

Except, of course, the "condition" "violated" would be a CalOSHA regulation!

Later, Clark claims, incredibly, that the state legislature expressly permits FilmLA to take the type of action AHF's initiative proposes, because in Chapter 6, Div. 1 §144 of the state Labor Code, it says (and Clark literally underlines), "Nothing in this section shall affect or limit the authority of any state or local agency as to any matter other than the enforcement of occupational safety and health standards adopted by the board."

So, if FilmLA revokes a permit issued to an adult producer because that producer is not using condoms, dental dams, goggles and face shields, that's somehow not enforcing "an occupational safety and health standard[] adopted by the board"???

"The conclusion is clear," Clark states in the final paragraph. "The Legislature allows local safety action, other than explicit enforcement of the Division's own regulations. It has done so in express and unambiguous terms."

Horseshit!

Sadly, most of the rest of the Editorial Board's article deals with how quickly the city needs to move, in light of Trutanich's lawsuit, to figure out whether the initiative can be put before voters on June 5, but devotes no analysis to the underlying issue, which it has editorially supported for more than a year. The article talks of deadlines like the first week in March, "when initiative documents are due at the County Registrar's Office"—a process that would require Judge Yvette Palazuelos to rule quickly on the suit after the date currently set for its hearing, January 25, and that if she took the allowable 90 days to hand down a decision, it would be too late to get the initiative on the ballot—meaning that things would continue in their current relatively safe manner until AHF pulls yet another in its long line of stunts.

But then, the Times' true agenda comes out:

"The council could cut through much of the morass by simply adopting the substance of the initiative into an ordinance by itself," the Editorial Board writes. "That would save the need for the election, the $4.4 million and the court hearing..."

And why the ellipses?

"— or would it?" the article continues. "Trutanich still would advise that the law was unenforceable, and that the city is likely to be sued and to incur unnecessary costs."

"See? Not quite so simple, is it?" the Editorial Board backpedals a bit. "So should The Times call on the City Council to let the suit go forward so we can get an idea whether the law would even be enforceable before spending money on an election? Or should we tell it to let the people vote and then see if the city is sued? Should we call on the council to just pass the thing into law itself?"

"Your thoughts [and] comments" can be left in the article's comments section—and it's an offer that every non-idiot of the adult industry should take them up on.

The source declined to say anything further regarding Red Light's intentions for the alleged tape, and owner David Joseph was unavailable for comment, but the official marketing of the content began in earnest today with the post on TMZ announcing its existence. The gossip site also quoted from unnamed sources saying the alleged tape features “two separate sexual encounters—one with a tatted-up man ... and one with a tatted-up woman (above) ... both shot within the last year.”

The footage is described as “private XXX liaisons," which stretches credulity, to say the least. Adding to the “mystery,” the TMZ scoop states, “And there's this—we're told there's even more Bombshell sex footage floating around, but it's so extreme ... RLD is considering not releasing it for legal reasons.”

Holy sex scene, Batman! So extreme it may not even be released? That can only mean one thing—Bombshell had sex on tape with someone without tattoos! If true, that is footage that must never see the light of day.

We also note that the colorful McGee, who came to national prominence as the other woman in Jesse James' complicated love life while married, has also flirted more directly with the adult entertainment industry by being featured last year on the website of talent agency L.A. Direct Models, though we are led to understand she did not book any sex scenes through the agency.

Thus, the alleged "civilian" sex caught on tape, which, if it is to be released commercially, will only be done with the signed consent of its leading lady. According to TMZ, the sex tape will be part of a two-DVD box set released in 2012.

Red Light District has some experience with high profile sex tapes, having acquired the DVD rights to Paris Hilton's infamous 1 Night in Paris back in the day.

LOS ANGELES—It is rare indeed when we link to a competitor's page but in this instance it would be unthinkable not to do so. Our dear friend Tim Henning has for 15 years done the heavy lifting at ASACP by personally reviewing reports of child sexual exploitation and forwarding on those that merit further attention from law enforcement. But now this quiet champion for all children is experiencing the unthinkable. His 8-year-old daughter is seriously ill and the cause remains a mystery. The nightmare has been going on since Aug. 9, an eternity for anyone whose very life is defined by the love they have for their children.

Tim has written a painfully beautiful expression of the anguish he is going through. We do not know how he did it. We are in awe. All we can do is express our deep appreciation for him and extend our heartfelt hope that his angel recovers fully and that one of the really good guys of our industry is able to get whole again.

In his missive, Tim is not asking for support or money or anything, really; just that people remain acutely sensitive to what's really important in life by refusing to fall prey to "the little worries and stresses" that consume so much of our daily lives.

"When you go home tonight give your kids, significant other, family a hug. Reach out to your family and friends," he writes. "Spend time with them, talk with them, play and have fun with them. Enjoy them and love them as much as you can. The moments are all we have … they will never come again."

LOS ANGELES—"Several"—or at least two—Los Angeles City Council members were "surprised... and angered" by the lawsuit filed December 8 by LA City Attorney Carmen Trutanich to prevent AIDS Healthcare Foundantion's (AHF) mandatory condom initiative from getting a place on the June 5 city ballot, according to news reports, so on December 13, Councilmembers Bill Rosendahl and Paul Koretz introduced a motion whose purpose is to quash the suit. According to search of the city Clerk's records, the motion passed.

"The filing of this litigation was unknown to members of the Council until after the posting of the agenda for today's meeting," Rosendahl and Koretz stated in their motion, even though AVN (and presumably other, more mainstream publications) wrote about the lawsuit on December 9.

Rosendahl and Koretz, both of whom have received campaign donations from AHF president Michael Weinstein, claimed in their motion that "Counsel for the California Occupational Health and Safety Agency has opined that the City can require the use of condoms in the adult film industry as a condition of the City's grant of a film permit." The pair appears to have been referring to a letter dated July 20, 2011 from James D. Clark, Staff Counsel to the California Division of Occupational Safety and Health (CalOSHA), which reads in part, "Conclusion: It is the Division's position that State law does not preempt such action [requiring condom use as a condition of receiving a filming permit] by the city because the City does not seek to enact an occupational health and safety standard but rather a public health standard applicable to any film activity (regardless of employment relationship) within the City Boundaries."

There's just one problem: Of course requiring that condoms (and possibly other "barrier protections" such as dental dams, goggle and face shields) is an "occupational health and safety standard," since by and large, the public plays no role in the creation of adult content, and no public outbreak of any sexually transmitted disease has ever been traced to the adult industry. But the most damning piece of evidence that CalOSHA regards this as an "occupational health and safety standard" is the fact that CalOSHA itself has held more than half a dozen public meetings over the past 18 months or so to discuss that exact issue: Condoms in porn.

So based on that absurd conclusion, Rosendahl and Koretz sought in their motion that "the Council act immediately to review this litigation prior to the Clerk issuing any opinion on the validity of this ballot measure"—and according to the City Clerk's website, they were successful.

It's important to state, however, that with 16 days having passed since AHF presented its petitions to the City Clerk for verification, the City Council has taken no steps as yet to simply enact the "condom clause" for adult film permits into law, as it has the power to do. And while it's unclear just how long the Council still has to take such action, in the absence of an affirmative vote on the issue, the initiative will appear on Los Angeles' June 5 ballot.

Curry will bring two decades of sales experience and an entrepreneurial mindset to Sportsheets. Curry will invigorate and fortify Sportsheets’ current client base by working directly with distributors to manage product placement and training, as well as streamline its customer service techniques.

“My goal is to increase Sportsheets’ sales and customer satisfaction while supporting and reinforcing our sales team,” Curry stated. “Together we will fine-tune our customer service system through active coaching and hands-on education, while learning from each other’s various experiences working within the adult retail and distribution realms.”
