MOBILESPACE—CTIA, the international nonprofit association representing wireless carriers, in collaboration with the Entertainment Software Rating Board (ESRB), has announced the development of a mobile application ratings system to be implemented next year. The announcement is an extension of CTIA’s 2010 Guidelines for Application Content Classification and Rating.

In a press release issued today, CTIA stated, “The CTIA Mobile Application Rating System with ESRB will utilize the well-known and trusted age rating icons that ESRB assigns to computer and video games to provide parents and consumers reliable information about the age-appropriateness of applications. Today’s announcement is an extension of CTIA’s 2010 Guidelines for Application Content Classification and Rating.

“AT&T, Microsoft, Sprint, T-Mobile USA, U.S. Cellular and Verizon Wireless are the founding members of the rating system, and other storefronts have indicated their interest in joining. As technologies and build-out schedules differ by each storefront, full implementation timelines will vary; each storefront may make its own announcement on when the rating system will be available for their customers.”

According to the Los Angeles Times, the age-based ratings categories will be the same as those used by ESRB for video games, adding, “The carriers, which sell apps via their own storefronts—much as Apple Inc.'s iTunes sells music—are expected to roll out the ratings sometime next year. Each carrier will decide for its own store whether the ratings will be mandatory for some or all apps, or entirely voluntary.”

iPhone apps will not be covered, since Apple already monitors them for inclusion in the Apple App Store.

The ratings process begins when apps are submitted to storefronts.

“When developers submit their applications to a participating storefront they will be able to complete a detailed yet quick multiple choice questionnaire that is designed to assess an application’s content and context with respect to its age-appropriateness,” the CTIA announcement reads. “This includes violence or sexual content, language, substances, etc., as well as other elements such as a minimum age requirement, the exchange of user-generated content, the sharing of a user’s location with other users of the application and the sharing of user-provided personal information with third parties.

“Once developers complete all answers to these questions, their applications are rated within seconds,” it continues. “Each rated app is issued a certificate and a unique identifying code that may be subsequently submitted to other storefronts during their respective onboarding processes, avoiding the need for developers to repeat the rating process. This means consistent ratings across participating storefronts and a convenient, cost-free process for app developers.”

Senator Mark Pryor (D-AR) said of the ratings initiative, “I applaud CTIA and ESRB on this consumer-friendly initiative. It’s a win-win when industry takes proactive, responsible steps to protect children from inappropriate content.” 

ECRB ratings for video games are:

Early Childhood
Titles rated EC (Early Childhood) have content that may be suitable for ages 3 and older. Contains no material that parents would find inappropriate.

Everyone
Titles rated E (Everyone) have content that may be suitable for ages 6 and older. Titles in this category may contain minimal cartoon, fantasy or mild violence and/or infrequent use of mild language.

Everyone 10+
Titles rated E10+ (Everyone 10 and older) have content that may be suitable for ages 10 and older. Titles in this category may contain more cartoon, fantasy or mild violence, mild language and/or minimal suggestive themes.

Teen
Titles rated T (Teen) have content that may be suitable for ages 13 and older. Titles in this category may contain violence, suggestive themes, crude humor, minimal blood, simulated gambling, and/or infrequent use of strong language.

Mature
Titles rated M (Mature) have content that may be suitable for persons ages 17 and older. Titles in this category may contain intense violence, blood and gore, sexual content and/or strong language.

Adults Only
Titles rated AO (Adults Only) have content that should only be played by persons 18 years and older. Titles in this category may include prolonged scenes of intense violence and/or graphic sexual content and nudity.

Established in 2002 by business partners Neal Slateford and Richard Longhurst, Lovehoney has achieved significant success within the UK retail sector, achieving in excess of 30 percent year-on-year growth for the past three years despite the economic downturn. The company’s most recent accounts showed a turnover of £13.4 million in the financial year ending March 2011, with pre-tax profits of £1.1 million.

MONROVIA, Calif.—The murder trial for the alleged killer of former soft porn model Felicia Tang, who was found dead in her home Sept. 16, is in a brief holiday recess. Her live-in boyfriend, Brian Lee Randone, 45, has been charged with beating and then suffocating the 31-year-old model, whose real name is Felicia Lee. Monday, Lee’s best friend took the stand to testify about their at-times wild lifestyle.

According to Monrovia Patch, “Shannon Donnan, who said she was best friends with Lee for about four years before her death, testified Monday that she and Lee would take the drug GHB together at parties that sometimes lasted for days.

“Randone's attorneys argue that Lee died of a drug overdose,” the article continued, “but the medical examiner who performed her autopsy determined that the 31-year-old was smothered to death.”

Of her friend’s drug use, Donnan said Lee would always take the same “responsible” amount, and liked to dance and sometimes roller-skate while on it.

"She was a goofball naturally and she was even sillier while we were high," said Donnan, who added that she saw Lee much less frequently after she started dating Randone, saying, “It went from her being at my home at least three days a week to not seeing her for three weeks at a time.”

Prosecutors have alleged that an ultimately fatal beating by Randone resulted in the 320 separate blunt force trauma wounds that were found on Lee's body; defense attorneys have argued the wounds were self-inflicted during the violent throes of a drug overdose. 

Testimony will resume Monday.

Instead of promoting solutions that offer individualized methods to filter unwanted content received on their mobile devices, these corporate service providers are trying to jump-start censorship at the network level, similar to mandatory ISP-level filtering being proposed in some countries.

One example of this entirely predictable and yet jaw-dropping strategy can be found in a press release issued Tuesday by Mobixell Networks and Commtouch.

These companies are using the time-discredited if popular ploy of “protecting children” to begin “a new effort to support mobile operators worldwide to comply with proposed Web content regulation.”

No such legislation has been passed into law yet, but that has not stopped Mobixell and Commtouch from putting subtle pressure on operators to comply with them. Though why not put the cart before the horse if the intent is also to encourage certain governments to not only get current bills passed, but also introduce new ones that target mobile networks?

“National governments, including those in the United Kingdom, Ireland, and Australia, are promoting legislation to protect children from pornography and other unsuitable Web content,” the release reads. “The ability for mobile device users, many of whom are minors, to freely access the Web, has made this an especially critical issue for telecom operators. If implemented, legislation would require operators to actively block undesirable content and make certain types of content available only if users opt-in to receive it.”

The double-speak in that paragraph is impressive, to say the least, even if the underlying intent is to reduce the level of speech on mobile networks to that found on a playground. Luckily for Americans, we have a First Amendment that thus far has protected us from this sort of wholesale restriction on protected speech, but they don’t have such protections in the countries mentioned above, or in many others.

Sadly, because we are all connected on the internet, ISP and network-level filtering could have dire consequences far beyond the borders of the countries that unwisely pass such laws. But that is of scant concern to these aspiring gate-keepers of censorship, these wannabe border guards of speech, who naturally also have a substantial financial interest in the legislation they are so cynically promoting.

LOS ANGELES—When, earlier this month, the daughter of the Uptown Girl managed to contract an STD downstairs, she went off the charts. Alexa Ray Joel, daughter of singer Billy Joel and model Christie Brinkley, middle-named after singer Ray Charles, was blindsided by the fact that boyfriends can carry more than a wallet and car keys in their pants. In the case of hers, the carrier had an STD called HPV, or the Human Papilloma Virus.

How Alexa learned that she had it has not been disclosed, though more likely than not, awareness came through a pap smear, something most women know all about and most men wonder of with abashed curiosity. But she told xoJane.com, "I had it, but I mean, a lot of people get it from my ex … There are no side effects. You just go and get it taken care of. ... I wasn't angry with him, because it's so common and he wasn't cheating on me. I mean, I was living with him; I saw him every day."? Hmmm … A lot of people get it from her ex makes one wonder if she was dating Magic Johnson (the only person to have been cured of HIV … well, according to him).

The fact of the matter is that HPV can be a deadly disease with devastating consequences. While most females have few long-term effects, the infection persists in 5-10 percent of women, and can lead to cervical cancer, necessitating a hysterectomy, or even cause death; nothing to take lightly. In 2008, the virus caused nearly 11,000 outbreaks of cervical cancer and 3,900 deaths. Worldwide, there are an estimated 490,000 cases and 270,000 deaths as a result of the infection. In a minority of cases, HPV can lead to cancer of the anus, cervix, vagina and vulva in women and of the anus and penis in men. It can also cause cancer of the tonsils, tongue and throat through oral sex. There are nearly 200 types of HPV known to exist, the majority of which have no symptoms; some cause genital warts.

Most people tend to only find concern from the type that brings genital warts, because it is an outward sign of the disease, readily apparent to their partners and a source of discomfort, especially during sex. But the difference here is the difference between eating chicken that has mold on it and chicken that is infected with botulism. The all-too apparent mold probably won’t kill you, but the invisible botulism most definitely will.

HPV is the most common of sexually transmitted disease in the United States. A 2007 report by the American Social Health Association estimated that 75-80 percent of sexually active Americans will be infected with the virus at some point in their lifetime.

Viruses are one of the simplest forms of life, rather like crystals with RNA at their core, but because of their hard protein shells, they are very difficult to kill. They cannot replicate on their own. Like the creature in Alien, they require a living host in order to breed. They do not think. They do not care, any more than a hurricane cares about the devastation it creates. They are what they are, because they cannot be anything else. They have done no good for any living creature, short of having thwarted the Martian invasion in H.G. Wells’ The War of the Worlds.

While there is no cure for HPV, there is now a vaccine for four of the most common strains. At this time, the CDC has recommended vaccinating all children with the preventative drugs, especially girls from age 11 on. Of course, the FDA, being what it is, has restricted the upper age limit to 26. Anyone older … sex be damned, just take it like a man and exert extreme caution or buckle under. But back to ARJ …

Alexa Ray Joel is who she is, in terms of celebrity or otherwise, as a result of her parents. But her words have been listened to, no matter why or how they came to be spoken, and therein lies her responsibility to not make light of such things. Adding insult to injury, Perez Hilton, commented, “Wow, that sucks!! But it’s prob the best one to get. We mean, out of all of ’em, that does sound like the easiest to get rid of.”

Wrong, Perez; and wrong, Alexa. HPV is not some tummy ache you get from eating too much ice cream. It’s a sometimes-deadly disease that comes from having sex with the sexually unconcerned. For when the threat of cancer or even death hangs over the infected like the sword of Damocles, the point should be well taken, because even the strongest of ropes can break.

NEW YORKNo one but the rattiest member of the Rat Pack would have dared call the Chairman of the Board a porn star to his face, but biographers get to say whatever they want, as long as the subject is no longer alive. That’s apparently the case with Frank Sinatra biographer Darwin Porter, who spent decades researching Frank Sinatra: The Boudoir Singer, which was released Nov. 8.

According to the Daily Mail, Porter writes in the bio that as a homeless and hungry youngster, the future Ol’ Blue Eyes was persuaded to appear in a blue movie.

“He was paid $100 for his contribution to a 1934 movie called The Masked Bandit at the age of 19, and spent the rest of his life hoping it would stay a secret,” the paper reported.

People close to the world famous singer and actor knew about the existence of the skin flick, however, and it was one of those who told Porter.

“[Porter] says he was told about the film by British actor Peter Lawford, one of the five members of the Rat Pack—Sinatra’s gang of movie pals from the 1960s which also included Dean Martin and Sammy Davis Jnr.” Davis, said Lawford, had somehow acquired a copy, and in 1972 he played a trick on Sinatra by “inserting footage of the movie into a reel of the porn film Deep Throat, which he then screened for a guest list that included Sinatra.

“Because Sinatra was masked, nobody at the private screening except Lawford, Davis and Sinatra knew who the skinny teenager frolicking with two naked actresses was,” reported the Mail. “The Rat Pack often played pranks on each other but Sinatra wasn’t amused. He masked his anger to keep the secret and, says Porter, was going to ‘cut Sammy Davis Jnr off for life, but then realized Davis might reveal his secret.’ Davis later agreed to destroy his copy of The Masked Bandit.”

Lawford also writes that Bandit surfaced years later when the makers of a documentary on Hollywood stars who go the flesh route before hitting it big planned to use a segment from the Sinatra movie.

“When Frank heard about this, he called his friends in the mob,” wrote Porter. “The bandit loop never resurfaced.”

Some suggest it did not resurface because it never existed in the first place. Another Sinatra biographer, James Kaplan, author of Frank: The Making of a Legend, said he has not heard about the Sinatra porn movie and theorized that Lawford, who had a famous falling out with the singer in the 1960s, may have made the whole thing up.

Unless an actual copy of that ancient skin flick is unearthed, we may never know if the star of From Here to Eternity and the heart throb of his day was also the James Deen of his day.

It may just warrant an Indiana Jones-like excursion down into the AVN catacombs (which twist and turn for miles beneath the unsuspecting streets of Chatsworth) to look through the cobwebbed 1930s shelves for The Masked Bandit. I just hope Frank isn’t down there waiting for me.

LOS ANGELES—Well, what do you know! A study out of Florida has found that people over the age of 65 who have sex regularly are by and large happier than people who do not. By regularly, we’re talking once a month.

That’s right. Amazingly, people were paid to conduct this study, which was done by the Florida Agricultural and Mechanical University—just the sort of higher education institution that one would expect to conduct a study on the sex habits of the fruit fly … er, older Americans.

Of course, the school is in Florida, and Florida has a lot of retired people; hence, the study. According to its author, assistant professor Adrienne Jackson, “will help open the lines of communication and spark interest in developing ‘outside the box’ approaches to dealing with resolvable issues that limit or prevent older adults from participating in sexual activity.”

Jackson surveyed 238 married people over the age of 65, almost 60 percent of whom who had sex more than once a month and described themselves as "very happy” with their lives and marriages.

However, psychcentral.com reported that the study’s results showed that “while about 59 percent of individuals who reported no sexual activity in the last 12 months said they were very happy with their marriage, almost 80 percent who had sex more than once a month said they were very happy.”

Now we’re confused. The respondents appear to have been asked essentially the same question a few different ways, resulting in confused results. In fact, several articles reporting on the study reprinted the same results, which to our ears sound eerily similar.

For instance, this is how the Baltimore Sun encapsulated the key findings of the study:

Forty percent who reported no sexual activity in the last 12 months said they were very happy with life in general. 

Sixty percent who had sex more than once a month said they were very happy.

About 59 percent who reported no sexual activity during the same time period said they were very happy with their marriage 

Eighty percent who had sex more than once a month said they were very happy with their marriage.

We added the bold to highlight why we’re confused. It looks as if everyone who was surveyed was “very happy,” no matter how much sex they were or were not getting. Nothing wrong with that, but where’s the news?

In fact, after looking through everything we can find about this study, we think the one and only conclusion that comes out of it is: sex or no sex, people who stay married longer are … drum roll … very happy!

BARCELONA, Spain—Private Media Group, which announced last week that it has been suspended from trading on NASDAQ, today released third-quarter results stating that for the three months that ended September 30, the company had net sales of 4.8 million Euros compared to net sales of 5.9 million Euros for the same quarter in 2010, a decrease of 1.1 million Euros, or 19 percent. Internet sales decreased 0.6 million Euros to 3.1 million Euros, which represents a decrease of 16 percent compared to the same period last year.

The company added the reduction in internet sales was primarily attributable to a decrease in sales from its North American websites as a result of foreign exchange rate changes and a reduction in sales from its gay content division.

Broadcasting sales decreased 0.1 million Euros to 0.8 million Euros, a decrease of 15 percent compared to 2010, caused primarily by fewer newly released titles being broadcast in 2011. Wireless sales decreased 0.1 million Euros to 0.3 million Euros, a decrease of 16 percent year over year. The decrease was attributed to the migration from on-portal sales to off-portal sales from Smartphone users. DVD and magazine sales also decreased: 0.3 million Euros, or 38 percent, to half a million Euros. The reduction was caused by an industrywide decrease in DVD sales in the period.

Gross profit for the period was reported to be 1.5 million Euros, down from 2.1 million Euros for the same period last year. The decrease as a percentage of sales was said to be the result of reduced sales and the impact of amortization of library and websites, which does not vary with sales.

Expenses were also reported to be down, however, with selling, general and administrative expenses pegged at 2.7 million Euros for the three months that ended September 30, 2011, compared to 4.6 million Euros for the same period last year, a decrease of 1.9 million Euros, or 42 percent. The decrease was reported to be the result of reduced payroll, expenses and depreciation by 0.9 million, 0.8 million and 0.2 million Euros, respectively. Operating losses were down, as well, from 2.5 million Euros in 2010 to 1.2 million in 2011, the result of reduced selling, general and administrative expenses offset by reduced gross profit.

All told, the company reported a net loss of 1.3 million Euros for the three months that ended September 30, 2011, compared to a net loss of 2.6 million Euros for the three months that ended September 30, 2010.

Looking forward, CFO Johan Gillborg stated, “As part of our digital strategy, we have established that the combination of Private with major online retailers and accomplished platform developers is the approach to achieving our goals in the rapidly changing business landscape. The combined content assets of Private and core competencies of GameLink and Sureflix offer a compelling new business model. We will be expanding our joint Internet strategies globally with additional formats and applications to be launched going forward. Currently we are reformatting and migrating all content on the GameLink VOD platform to a Content Delivery Network (CDN) and we expect this to enhance the user experience substantially and therefore improve both conversion and retention rates in general, but particularly in eastern North America and in Europe. This is a paramount initiative which is expected to increase sales significantly and also make it possible to expand our cooperation with affiliates worldwide. In addition, this initiative is crucial for the development and distribution of apps which will enable consumer access from the growing market of SMART TVs. The completion of the CDN initiative is expected to take place before the end of 2011.”

The company also plans to significantly increase the number of new titles it releases, which it says will have a positive impact on broadcasting and DVD and magazine sales.

“During 2011, the DVD market for adult content has continued to shrink, with sales for our physical products declining by 37 percent,” added Gillborg. “However, the DVD has by no means disappeared, even in this competitive landscape. The content providers who manage to survive the current market climate will control the DVD market going forward.”

LOS ANGELES—In the wake of the ever-expanding child sex abuse scandal at Penn State, AP reporter David Crary reminds us that the United States has experienced a dramatic drop in such cases over the past 20 years.

“Of the two most authoritative national reports,” he wrote, “one shows incidents of child sex abuse down more than 55 percent since 1992 and the other documents a 38 percent drop between 1993 and 2006. There are many reasons: more vigorous efforts by police and prosecutors, growing public awareness, effective treatment of abusers, better screening of people who deal regularly with children.”

The Penn State episode reveals that an extremely disturbing level of institutional denial still exists in the country, and no one in the child protection field is ready to claim victory when tens of thousands of minors are still abused annually, but the statistics nonetheless reveal marked progress in dealing with a crime whose victims are all but powerless to stop.

The perception that things have never been worse, while inaccurate, is understandable considering the media’s proclivity to report bad news first, but according to Chris Newlin, executive director of the National Children's Advocacy Center in Huntsville, Ala., there is a real world reason why the reality of the situation needs to be promoted.

"We should change our messaging," he said. "We should be saying, `We have meaningful programs that are making a difference in reducing child abuse, and now is the time to continue–if not increase–your support of these efforts.'"

One of the worst by-products of the false perception is the tendency for victims or their parents not to report assaults. Sometimes they stay silent out of guilt, shame or fear; sometimes because they do not think anything will be done. Unfortunately, the Penn State episode will only reinforce the latter apprehension. But the fact remains that nationally, and state by state, the numbers indicate substantial decreases in the number of sexual abuse cases handled by professional agencies.

For instance, in Pennsylvania, reported Crary, “the number of substantiated sexual abuse reports handled by the Office of Children, Youth and Families dropped from 2,501 in 2000 to 1,963 in 2010.”

Pennsylvania data also supports national data that indicates most victims of child sex abuse know their abusers.

“Studies suggest that only about 5 percent of child sex abuse is perpetrated by a stranger, with about 40 percent committed by family members and the rest by an acquaintance of either the child or the family,” reported Crary. “Those demographics represent a major challenge if further inroads are to be made against child sex abuse, according to Mark Chaffin, a pediatrics professor who directs research at the University of Oklahoma's Center on Child Abuse and Neglect.”

Teen Pregnancies

A just-released study by the Centers for Disease Control and Prevention (CDC) shows teen pregnancies hit an all-time low in 2010. The data was culled from 100 percent of birth records collected in all 50 states, the District of Columbia and U.S. territories. 

“The birth rate for teenagers aged 15–19 has declined for the last three years and 17 out of the past 19 years, falling to 34.3 births per 1,000 teenagers in 2010—a 9 percent decline from 2009 and the lowest rate ever recorded in nearly seven decades of collecting data,” said the CDC in a press release issued Thursday. “Birth rates for younger and older teenagers and for all race/ethnic groups reached historic lows in 2010.”

Other findings from the study include:

* The total number of births in the United States declined 3 percent, from 4,130,665 in 2009 to 4,000,279 in 2010.

* The overall fertility rate also fell by 3 percent from 66.2 births per 1,000 females aged 15–44 in 2009 to 64.1 in 2010. This is the third straight decline for the overall fertility rate in the United States. 

* The total number of births to unmarried mothers declined for the second year in a row to 1,633,785, down from 1,693,658 in 2009.

* The birth rate for unmarried mothers also fell to 47.7 per 1,000 unmarried mothers in 2010 compared to 49.9 in 2009. The percentage of births to unmarried mothers also declined slightly in 2010 to 40.8 percent compared to 41 percent in 2009.

* The birth rate for women in their early twenties fell 6 percent in 2010.  The rates also fell for women in their late twenties and thirties. However, the birth rate for women in their early forties increased to 10.2 per 1,000 women 2010 compared to 10 in 2009, making it the highest birth rate for this age group since 1967.

* The preterm birth rate declined for the fourth straight year in 2010, to just under 12 percent of all births (11.99) – a 6 percent drop from 2006.

* The low birthweight rate was essentially unchanged between 2009 and 2010 at less than 8.2 percent in 2010, but is down slightly from the record high of 8.3 in 2006.

Though no one would dare say that either child sexual abuse or teen pregnancies are societal issues that no longer need to be dealt with, there remains a dedicated faction of social conservatives who continue to promote the unsupported notion that the country is headed in the wrong direction when it comes to sexual abuse and under-age sex. They usually (and increasingly) point to porn, and especially internet porn, as the original sin, the gateway drug that leads to all other sins, and declare that we are in the middle of a national health crisis as a result.

Maybe, instead of pointing to bogeymen of their own making, they should take a hard look at the data, and take a moment to listen to Sarah Brown, CEO of The National Campaign to Prevent Teen and Unplanned Pregnancy, who made the following comments yesterday in reaction to the CDC results.

"I am aware of no other social problem that has improved so dramatically over so many years," said Brown. "Progress in reducing teen pregnancy has been nothing short of remarkable—the teen birth rate has declined a stunning 44 percent between 1991 and 2010. There have been impressive declines in all 50 states and among all racial/ethnic groups. Not so long ago, teen pregnancy was viewed as intractable and inevitable. This report shows that too early pregnancy and child-bearing are 100 percent preventable.

"The magic formula of less sex and more contraception is responsible for this great good news," she continued. "Teens are being more careful for a number of reasons, including the recession, more media attention to this issue—including the '16 and Pregnant/Teen Mom effect'—and more attention to and investment in evidence-based programs. But at the end of the day, the thanks and admiration go to teens themselves."

WASHINGTON, D.C.—Although citizens are allowed to deduct unreimbursed medical expenses from their federal tax returns, a new ruling by the U.S. Tax Court allows transgendered persons to deduct the costs of treating their "gender identity disorder" (GID), including hormones, sex-reassignment surgery, therapy and other expenses related to the treatment of GID that satisfy the requirements of Section 213 of the Internal Revenue Code.

The case involves Rhiannon O'Donnabhain, who paid for the hormone therapy and surgery to change from male to female, but when she tried to deduct those expenses from her 2010 tax return, the IRS disallowed the deductions because they "did not treat a medically recognized disease or promote the proper function of the body," according to the Tax Court ruling in her case.

"The Tax Court agreed with Ms. O’Donnabhain that her gender identity disorder is a disease within the meaning of §§ 213(d)(1)(A) and (9)(B)," the court ruled (.pdf). "The court cited four bases for its conclusion: 1) the disorder is widely recognized in diagnostic and psychiatric reference texts; 2) the texts and all three experts testifying in the case consider the disorder a serious medical condition; 3) the mental health professionals who examined Ms. O’Donnabhain found that her disorder was a severe impairment; and, 4) the Courts of Appeal generally consider gender identity disorder a serious medical condition. The court held that because hormone therapy and sex reassignment surgery treat the taxpayer’s disease they are medical care, and the expenses for that medical care are deductible under § 213."

Although the Tax Court ruling is careful to note that, "THIS DOCUMENT IS NOT TO BE RELIED UPON OR OTHERWISE CITED AS PRECEDENT BY TAXPAYERS," IRS Branch Chief Thomas D. Moffit nonetheless wrote, "The Service will follow the O’Donnabhain decision. The Service will no longer take the position reflected in [IRS claim rejection] CCA 200603025."

Still, as the GLAD.org website noted, O’Donnabhain was not able to deduct her breast enhancement surgery.

"The Court felt that she had obtained 'normal' breasts through hormone treatment and concluded that there was insufficient documentation by the doctors that this procedure was needed for the treatment of Rhiannon’s GID. However, this does not preclude you from claiming breast surgery as a medical deduction for the treatment of your GID. The bottom line is to make sure that you have the strongest medical documentation possible for each part of the treatment for which you are claiming a medical deduction."

Nonetheless, they still hailed the Tax Court win as a major victory for transgenders.

"This is a very strong decision, recognizing the legitimacy of GID as a medical condition and, therefore, that expenses related to the treatment of GID may be deductible," the GLAD site notes. "If you have had treatment for GID and are trying to decide whether you should claim related expenses as a medical deduction on your federal income tax, here is some information that may help you to decide. We are, however, not able to provide specific legal advice, so we strongly recommend that you take this information to a tax expert—a CPA or tax attorney—who can assist you in making your decision."

CAMBRIDGE, Mass.—Ivy Leaguers, can’t you all get along? Must you compete in every arena of life? Is it not enough that the scions of the 1 percent compete to see which will attract more of the nation’s top high school graduates? Is it not enough that you get to compete with one another in your own sports league called… what else, The Ivy League? 

Now you have competing Sex Weeks in the works? What’s next; comparing penis sizes? Alas, this is really happening, with an element of intramural competitiveness also in play, as evidenced by the Harvard Crimson article posted Wednesday by Kristiana C. Laugen, with the title, “Too Much Porn at Yale Sex Week.”

Though ostensibly about Yale, the post is really about the planned Sex Week at Harvard College, which is scheduled to take place the week of March 25, 2012, and will be coordinated by the Harvard student organization, Sexual Health Education & Advocacy throughout Harvard College (SHEATH).

In her post, Laugen wrote, “Although ‘Sex Week at Yale" had a similar mission, after reevaluating the actual content of the events, Yale determined that the content of "Sex Week at Yale" had strayed from its original mission. In fact, Yalies complain the week has become more about porn than sexual issues, claiming about one third of the events are hosted by people involved in the adult video industry.

“But before you knock Yalies for being too prudish,” she added, “it might do to remember that Yalies traditionally have a higher average number of sexual partners than Harvard students—2 for Yale compared to 1 for Harvard within their four years according polls conducted by their respective newspapers. Well, at least Yale is good at something.”

Despite the good-natured snark, the perceived focus on porn that developed at the Yale event was certainly on the minds of Harvard Sex Week organizers.

“There are things that Sex Week at Yale does really well, there are also things that Sex Week at Yale could do better,” said SEATH co-founder Samantha A. Meier who graduates next year. “We’re interested in providing programming that Harvard students are going to like and that will serve as a launching pad for more discussion.”

According to an official announcement in the Crimson, Harvard Sex Week organizers will collaborate with various Harvard organizations to sponsor individual seminars and workshops that address topics such as the hook-up culture of college, and that try to foster better sexual communication on campus.

“Our role is connecting groups that are already doing amazing work on campus and making sure they have a platform and the ability to work in conjunction with other groups,” said Meier. “This isn’t just our vision for Sex Week.”

Brown University also has a Sex Week, reminded Meier, who added that she and fellow SHEATH founder Abby Sun have already been in touch with organizers of Sex Week events at both Yale and Brown in order to learn from the successes and failures of those events while meeting the special needs, whatever they may be, of the Harvard, Cambridge and Boston communities.

Assuming Yale gets the green light to continue its venerable Sex Week, we look forward to the inevitable Ivy League Sex Week—which in our imaginations will combine all three events, complete with jaw-dropping sex-themed competitions, during some splendiferous and verdant New England weekend—even if adult companies are no longer invited to participate.

CANOGA PARK, Calif.Free Speech Coalition (FSC) has opened nominations for its 2012 Board of Directors election. Out of 13 board seats, there are four adult industry trade association board positions up for election.

You must be an FSC member to make a nomination. Active FSC members should have received an email form that allows them to nominate candidates for election (sent through survey service Zoomerang). FSC will also post a link on its website, the FSC Blog and Facebook page, if members would prefer to access the nomination form through those platforms or did not receive the email form.

PALO ALTO, Calif.—Though Facebook is not naming names, it has reported that it knows the identity of the people responsible for this week’s porn and gore infestation, and it does not appear to be Anonymous, the notorious hacking group that had previously threatened to attack Facebook over privacy and billing practices it did not like.

Though it is keeping identities under wraps, the social network said it will pursue legal action against the people responsible for the unprecedented attack that breached the Facebook Immunity System (FIS), which reportedly analyzes 650,000 actions a second, leading many users to consider closing their accounts altogether.

FIS has been an effective barrier against many threats, but it isn’t perfect, according to PC World, which reported that “earlier this month, researchers showed how botnets could be created to harvest information from members without being detected by FIS.”

The latest attack, which also avoided detection, “was based on tricking members into pasting JavaScript code into the address bar of their browsers. The code caused a member to share offensive material with their friends.”

According to firsthand accounts from colleagues as well as news reports from outlets such as msnbc.com, images containing porn and extreme violence were still showing up in people news feeds, but seemingly not as frequently as earlier in the week or last week, when the scam first began.

Now, as U.S. lawmaker wants answers. Rep. Mary Bono Mack (R-Calif.) wants her people to meet with Facebook "to make certain—to the extent possible—that it doesn't happen again," said Mack spokesperson, Ken Johnson.

"We've put in place backend measures to reduce the rate of these attacks and will continue to iterate on our defenses to find new ways to protect people,” Facebook said Thursday.

For politicians already concerned about the social network’s commitment to privacy, such assurances may ring hollow.

BEIJING—According to China’s most famous (and troublesome) living artist, the painter, sculptor and architect Ai Weiwei, the government has targeted his assistant in a probe into allegations he spread pornography online as a way of getting back at Ai for his continuing activism. 

The assistant, videographer, Zhao Zhao, told Ai he was summoned by the police Thursday and asked about a photo he took last year of Ai and four women, all of them nude, titled “One Tiger, Eight Breasts.”

The photo, though featuring topless women, is all but devoid of sexual innuendo, which puts it at the extreme margin of anyone’s definition of porn, and especially Wei’s.

"If they see nudity as pornography, then China is still in the Qing dynasty," he said.

According to Zhao, the police told him the photo was illegal and that they may pursue criminal charges against him.

"They said, 'This photograph is an obscene photograph,’” he said. “I said, 'I didn't know that, what's obscene about it?' They said, 'It's just obscene.' They've already decided that.”

No charges have been pressed, and the investigation appears limited to Zhao at this point, but neither he nor Ai believe either the photo or the assistant are the intended target. Rather, the government appears determined to inflict a certain level of punishment upon Wei for past dissident activities, and more recently, for, as one news report put it, turning the tables on the regime’s attempts to silence him.

Ai, the son of a famous Chinese poet who was himself persecuted and then reformed by the Chinese Communist Party, has used his fluency in English, as well as his ability and willingness to use the internet to communicate to a domestic and international audience, drew the ire of the government when he tallied the or tallying the number of children killed in the 2008 Sichuan earthquake. It was hugely embarrassing to the government because, according to AFP, “… many died in schools that were shoddily built and collapsed onto them, which many blamed on corruption.”

In April of this year, Ai was detained for a hefty 81 days, during which time, according to the Telegraph, he was accused of tax evasion, bigamy and for spreading pornography online.”

Released in June, Ai was then informed by the government in November that his design company, Beijing Fake Cultural Development Ltd., owed 15 million Yuan in back taxes (approx. $2,359,000). That’s when the artist’s immense popularity truly reared its head.

“Days later,” reported AFP, “a spontaneous online movement to help Ai began. Supporters sent him money orders, checks, internet transfers, and even rolled bank notes into balls and threw them over the walls of his Beijing studio.

“Visitors flocked there—some from as far away as Hainan island in the south, some 3,000 kilometers (1,860 miles) from the capital. Within 10 days, 8.7 million Yuan had been raised from artists, dissidents and ordinary Chinese, who accounted for the bulk of the donations.”

Earlier this week, Ai paid $1.3 million guarantee into a government bank account as a guarantee that allows him to continue contesting the tax assessment, which had to only further embarrass the government, which in turn allegedly targeted Zhao, the assistant, who admitted after his meeting with the police on the trumped up porn charges that the harassment is probably far from over.

"To them so far their efforts have had no effect, such as the tax case, so they are trying this from other angles," said Zhao. “They are again raising this [porn] issue, and will keep repeating this over again. They won't easily let him off."

Digital Piracy Is Common in the United States

LOS ANGELES—Considering the anti-piracy measures currently being considered by the House and Senate, a preliminary report just released detailing the extent and type of digital piracy that is currently taking place in the United States is impeccably timed. Sponsored by Columbia University’s The American Assemble project, and supported by a research award from Google (of all companies), the results, released this Tuesday, were excerpted from a larger impending survey-based study titled, Copy Culture in the U.S. and Germany.

“Drawing on results from the U.S. portion of the survey, it explores what Americans do with digital media, what they want to do, and how they reconcile their attitudes and values with different policies and proposals to enforce copyright online,” wrote Joe Karaganis, vice president at The American Assembly.

The U.S. portion of the survey was conducted by Princeton Survey Research Associates International. The results are based on interviews on landline and cell phones conducted Aug. 1-31, 2011 with 2,303 adults living in the continental United States.

Though the full results of the survey will not be released until early 2012, the preliminary report provides a revealing snapshot of the extent to which average Americans engage in various levels of digital piracy.

While the study addresses digital piracy related to non-adult-oriented content such as music, mainstream movies and television shows, the results of the study can be somewhat extrapolated to the illegal use of pornography. However, it also is possible that attitudes regarding the pirating of adult content will be different from those regarding mainstream content, especially among young people. In other words, though the principle is the same, the likelihood exists that a sizeable percentage of respondents would have said that pirating adult content is more acceptable than pirating non-adult content.

Preliminary conclusions are:

* ‘Piracy’ is common. Some 46 percent of adults have bought, copied, or downloaded unauthorized music, TV shows or movies. These practices correlate strongly with youth and moderately with higher incomes. Among 18- to 29-year-olds, 70 percent have acquired music or video files this way.

* Large-scale digital piracy is rare, limited to 2 percent of adults for music (>1000 music files in collection and most or all copied or downloaded for free) and 1 percent for film (>100 files, most or all from copying or downloading).

* Console-based video game piracy is very rare, limited (on any scale) to 1-2 percent of the population.

* Legal media services can displace piracy.  Of the 30 percent of Americans who have ‘pirated’ digital music files, 46 percent indicated that they now do so less because of the emergence of low-cost legal streaming services; among TV/movie pirates, 40 percent.

* Copyright infringement among family and friends is widely accepted (75 percent and 56 percent, respectively, for music; 70 percent and 54 percent for film). In contrast, activities that imply dissemination of copyrighted goods to larger networks receive very low levels of support.

* Only a slim majority of Americans (52 percent) support penalties for downloading copyrighted music and movies—and limit this support to warnings and fines.  Other penalties, such as bandwidth throttling and disconnection, receive much lower levels of support.

* Disconnection from the Internet, in particular, is very unpopular, with only 16 percent in favor and 72 percent of Americans opposed.

* Among those who support fines, 75 percent support amounts under $100 per song or movie infringed—hugely undershooting the current statutory penalties.

* For a majority of Americans (54 percent), due process in such matters requires a court—not adjudication by private companies.

* Solid majorities of American internet users oppose copyright enforcement when it is perceived to intrude on personal rights and freedoms.  69 percent oppose monitoring of their Internet activity for the purposes of enforcement. 57 percent oppose blocking or filtering if those measures also block some legal content or activity.

* Comparable majorities (56 percent) oppose government involvement in “blocking” access to infringing material. This number increases to 64 percent when the term “censor” is used.

* Blocking and filtering by commercial intermediaries such as ISPs, social media sites, and search engines receive majority support—until the questions include likely consequences. Majorities of internet users support requirements that ISPs and search engines “block” infringing material (58 percent for ISPs; 53 percent for search engines). This support runs as high as 61 percent for a soft requirement that user-content driven sites like Facebook “try to screen all material and reject pirated copies of music and videos.” But this majority disappears when blocking by ISPs is characterized as censorship (46 percent support), falls further when associated with the blocking of legal content (36 percent support), and still further when it implies surveillance of Internet use (26 percent support).

* Which scenario best approximates the Stop Online Piracy Act?  In our view, ISP blocking that also blocks some legal content. In this case, internet users oppose blocking: 57 percent to 36 percent.

AUSTRALIA—The Australian Sex Party has accused the Australian government of following the U.S. in a sustained attack on civil liberties through new legislation to curtail the internet. 

“Right now, the US congress is considering legislation which would allow censorship of anything suspected of copyright infringement, and mandate information relating to such activity and the identities of users, to be handed to law enforcement authorities,” said Sex Party President, Fiona Patten.

In a prepared statement issued Thursday, the Sex Party accused the Australian government of already beginning the removal of due process rights during prosecutions of copyright infringement. Referring to anti-piracy legislation currently pending in both the Senate (PROTECT IP Act) and the House (SOPA), the Sex Party asserts that the U.S. bills, if approved, could signal an expansion of the surveillance and dubious legal tactics already being employed in Australia. The Attorney-General’s department, for instance, has refused Freedom of Information requests for details of closed-door meetings with industry stakeholders, in the process casting doubt on the government’s motivations.

“The enforcement of copyright laws must be balanced with the right to privacy, and the due process of our legal system is paramount; to erode it is to ignore the foundations of fairness in our country,” Patten said. “The Attorney-General, Robert McClelland is threatening the rights of ordinary Australians for the sake of so-called movie rights groups, established to profiteer from such actions, not to benefit artists and those who create movies and other entertainment. This, coupled with the ever-present threat that Senator Conroy will again lead the charge to re-introduce internet censorship legislation, paints a bleak future for freedom in Australia.

“We must not follow the U.S. legislative approach blindly,” she added. “The US-Australia military alliance must not extend to militant legal action against Australians. Government must stop using pornography, child protection and copyright infringement as excuses to violate the rights of individuals to privacy and freedom. It is not the Government who should parent children, rather, parents need to take responsibility for their children’s welfare, and adults must be afforded the rights they are entitled to.”
