CYBERSPACE—In the wake of the suspension of ePassporte’s ability to use the Visa network, an old friend of adult has returned to the fold. PayPal, which used to be very adult-friendly before being acquired by eBay in 2002, appears to be once again allowing the use of its network by adult entertainment companies as a B2B payment option. C2B payments, however, have as yet not been revived by the global peer-to-peer payment platform.

Despite the fact that there has been scant public mention of this development, several companies have already integrated the option into their drop-down menus for use by their affiliates.

AVN has identified several programs now offering PayPal to affiliates, some of which have already sent out notices informing the affiliates of the fact. Before naming the programs, AVN thought it wise to contact each for comment, and a few have replied, asking that they not be quoted or mentioned as having opted to integrate the service into their payment options.

One program that agreed to be mentioned and quoted, however, was TopBucks/Pink Visual, which provided the following statement.

“Naturally, we want to provide our webmasters with as many options for receiving payment as possible, so we're happy to bring PayPal back into the mix on TopBucks,” said Q. Boyer, TB director of public relations. “We've used PayPal for B2B payments to other companies and vendors in the industry on occasion, without any problems, for some time now. We don't anticipate encountering any problems with using it to pay our webmasters, either.”

Existing affiliates of TopBucks can choose PayPal as a desired payment option simply by choosing it from the drop-down menu in the form that allows them to edit their existing account information; new signups are required to contact TopBucks before the PayPal options will be made available to them.

AVN also has a query into PayPal but had received no reply by post time.

LOS ANGELES—Comedians Jake Weisman and Eli Olsberg bring the inaugural season of their porn-themed show The Morning After ... Podcast to a close Friday night by taking it live at Meltdown Comics, with adult star Kimberly Kane and comic Steve Agee (The Sarah Silverman Program) appearing as the featured guests.

Since last April, new episodes of The Morning After have been posted online each Monday morning, with an array of adult industry professionals from both in front of and behind the camera joining the show, as well as other comics. For Friday's event, former guests Bobbi Starr, Andy San Dimas and the show's very first visitor, Dana DeArmond, will be returning, as will Ed Salazar (Web Soup), Renee Gauthier (Chelsea Lately) and Kumail Nanjiani (The Late Show With David Letterman).

The Morning After, Weisman told AVN, examines the adult industry from a "laid-back and sociological approach, but obviously with humor injected throughout."

Explaining that he and Olsberg knew each other well from the L.A. stand-up circuit before creating the show, Weisman said, "We were frustrated by how people in porn were portrayed and treated by the mainstream media. We both found the industry to be a much more interesting, entrepreneurial place than people gave it credit for. Eli and I are definitely fans of not only pornography, but big supporters of anyone's right to engage in or produce pornography. Both of us find the taboo of porn to be ridiculous. It's just sex, and everybody does it, and people should probably just calm down."

Interestingly, Weisman also claimed a decidedly alternate viewpoint on the subject shared by Olsberg and himself from what you'd expect out of two dudes: "We both are fairly well-versed in feminist studies, as Eli was a Women's Studies minor in college and I have three sisters, a mother, two female cats, and a penchant for hating alpha males." 

Weisman cited the film Boogie Nights as a major turning point for the de-tabooing of public discourse on porn. "I felt like it was one of the first instances where it seemed OK for people to discuss porn, and not just think it was evil," he said. "So, although I have always been someone who watched porn, after Boogie Nights I found myself watching documentaries on porn, and wanting to know more about the industry. Eli, I believe, watched porn from a young age, and has always wanted to write about the porn industry, but wasn't sure what the correct medium would be. The podcast seemed like the ideal place for him to discuss and learn about the industry."

In addition to the star-studded lineup of Friday's Morning After presentation, Weisman said the show will include "a raffle with all sorts of fun things that various companies and people from the industry have given us, and we have a new segment called 'Fast-Forward the Plot or Not?' where we bring up comedians to watch scenes from a few mainstream adult films, and discuss whether we want to watch the movie or fast-forward straight to the sex scenes. It's going to have a Mystery Science Theater 3000 vibe and humor."

Meltdown Comics is located at 7522 Sunset Blvd. The show begins at 8pm. Advance tickets are available for $10 at the Meltdown website, and will be $12 at the door.

WASHINGTON—New adult studio Capitol Entertainment Agency (CEA) has tapped Lee Roy Myers to co-direct its inaugural release, a spoof of presidents past and present.

Myers has begun pre-production on the title, Here Cums the President, which begins shooting in Los Angeles next month. Myers has planned a historically accurate film parodying the sexual deviance of the country’s commanders in chiefs.

Myers told AVN that he’ll be focusing on Franklin D. Roosevelt, Lyndon Johnson, John F. Kennedy, Bill Clinton and Richard Nixon and their sexual—and often hilarious—escapades.

The movie’s star-studded cast features Lisa Ann, Jenna Haze, Asa Akira, Marie Luv, Jenny Hendrix and 2010 AVN Female Performer of the Year Tori Black.

CEA, based in the nation’s capital, will be producing mostly comedies and original features. “It will be a mix of a few different genres,” Myers said. “Some will be more sketch comedy based, others will be linear stories. All will feature big stars and be high-quality productions. It’s going to be something fun and different.”

Here Cums the President is one of the funniest scripts Myers said he’s read. “I think the reaction will be: ‘Wow, this is funny. Wow, this is weird. This is controversial. OK, and the sex is hot. I have to go masturbate now.’”

Ronald Raygun, new to the adult business, wrote the script, which Myers said “doesn’t dumb down the comedy for porn’s sake,” and will be co-directing along with Myers. Myers’ go-to cinematographer, Dr. Philgood, adds to the creative team. 

“These guys mean business,” Myers said of CEA. “They spared no expense for cast, crew, costumes, sets. They are even making sure that Here Cums The President is, pardon the choice of words, filled with anal sex. I think that everybody is going to be shocked with how deep we are going to have the presidents dig.”

Myers plans to continue working with CEA on future projects after his debut release for the company.

“Capitol Entertainment Agency is a new company specializing in the funniest, most controversial, and sexiest hardcore adult films you will ever see,” CEA’s Mr. B said. “Our goal is to have the biggest and best cast, directors, and film crew so that CEA can show people a whole new side of adult movies.”

Media Copyright Group’s John Steele: Pirate Slayer

CHICAGO—John Steele is a Chicago-based attorney whose main practice focuses on the conventional areas of family law, divorce and consumer bankruptcy. But like a caped-crusader, he has extended his legal aspirations into the relatively new and aggressive arena of copyright infringement lawsuits targeting anonymous infringers who obtain their content from Torrents. While certainly not the only attorney to stake a claim in this area, his Media Copyright Group has seen a lot of action lately on behalf of clients that might not necessarily utilize the services of his “daytime” firm: adult production studios.

Steele is already well into three lawsuits on behalf of adult studios—Hard Drive Productions, Lightspeed Media, and Millennium TGA—and he told AVN that several more are being prepared. The litigious floodgates are wide open, his legal guns are locked and loaded, and as the following interview makes clear, the crosshairs are now centered squarely on the illegal downloader.

You have three lawsuits filed already. Are there more coming down the pike?

Yes, we have about ten lawsuits in various stages of readiness, including three more we will be filing tomorrow morning on behalf of new clients, with larger numbers of John Does, probably closer to a thousand.

Your approach is to file suit, enter discovery and obtain the identifying information of the alleged infringers and then try to negotiate a settlement with them. Could you subpoena ISPs for that information before filing a lawsuit?

No, you have to have an underlying cause of action in order to issue discovery and a subpoena is just one part of discovery.

What happens after you get the identifying information from the ISP? Do you attempt to negotiate with each and every one of the alleged infringers?

Yes, we attempt to reach out to everybody. We get a certain small percentage of people who say, ‘Hell no, we’re going to hire an attorney and fight it,’ and we say, okay, that’s fine, and just proceed along. Of course, statutory figures are in the six figures, so usually that’s just bravado on their part. Other people want to work something out or begin a process of verifying the information that we have, and we understand that, too. People want to make sure about their chances of winning (or losing) before entering into a settlement. We’ll always work with people. Just the other day, a guy said, ‘Okay you got me, but I don’t have the money to pay you off in one lump sum, can I pay it off in three payments?’ We said, sure. We want to minimize the effect of this on everyone. Even if they brought it upon themselves, there’s no reason to make a mountain out of a molehill.

You mentioned six figures? Are most of the targeted people multiple offenders or are some of them people who downloaded once or twice?

First, I would bet—though I don’t have any proof—that everyone we’ve gone after is a multiple offender, but we only go after people for one violation that we have caught them doing. There are certain statutory damages that are allowed under U.S. Copyright law, and the damages can go up to $150,000. But there is a range [of fines], and in the end it depends on the judge and the judgment and a lot of factors, but it can go up that high.

How seriously do you take the security of the data or identifying information of accused illegal downloaders? I’m thinking of the British law firm in trouble for allowing similar information to be stolen by hackers.

I would first say that to the extent that any law firm doesn’t protect the data in keeping with whatever statute there is, they are liable for bad conduct. I don’t necessarily blame them for having their data stolen because obviously that happens to a lot of companies. But yes, we take data security very seriously, and we protect the data that is sent to us to the best of our ability. 

Do ISPs send you the information about these people in encrypted form?

No, they usually do not. There is no requirement that I am aware of that they have to do anything other than simply mail us the information. We get much more incriminating information from other lawsuits all the time. Besides, the name and phone number of someone who has an IP address is just one little piece of the entire evidence puzzle.

What about the people who simply deny that it was them doing the downloading, or that you got the wrong IP address, or that sort of thing?

We are not like the recording industry in that we get a lot of false positives; in fact, I don’t believe we’ve had a single one. Our software is very advanced; it’s all customized and proprietary, so we have an amazing amount of incriminating data and information about each one of the people we’re going after. By the time we have had a conversation with these people, they have long since stopped denying that they did it, let’s just put it that way.

On another note, I read a study recently that said 99 percent of all BitTorrent content is illegal, so I have a real problem when people say they didn’t know it was illegal, or people saying we’re picking on people downloading. It’s like the Napster argument. We all know that when you get a hundred million dollar movie like Batman for free because you went to this sketchy looking website that didn’t have anybody’s ownership on it, you know that’s not legitimate. If you’re going to argue that you didn’t know, you’re like the guy who gets pulled over for speeding and says he didn’t know. Well, too bad, you were speeding, and our legal system says that ignorance is no defense.

I’ve had a lot of conversations with people who have called the office and said, ‘Oh, this is what happened, my son downloaded it, or whatever.” Well, the court system here thankfully puts the responsibility on the car driver for the purposes of speeding tickets, and on the owner of the ISP account for the purpose of illegal downloading. In almost all contracts with internet service providers, people promise not to engage in illegal activity with the bandwidth that the ISP provides them, and the ISP then gives them dynamic IP addresses that change every two days or so.

The technology sounds new. Are these basically test cases for the effectiveness of your technology in court?

All I can say is that the technology we have does make it practically impossible to have a false positive, but obviously the details are a trade secret. Regarding whether or not the evidence will hold up in court, our research and experience shows us that because of the way it is compiled and the way the data is grabbed from the defending party, we don’t see how there could be any argument to exclude it. Obviously, if the evidence is excluded, we don’t have much to present to the court that the person is a defender, but thus far the courts have ruled in our favor on almost every issue relating not only to our evidence but also our right to find out the identities of the offenders.

Why are all of these adult cases happening now?

I think part of it is that there were some decisions handed down in the District of Columbia that made it easier for these lawsuits, but I also think the technology has caught up with the problem. It took us nine months to develop our software, but since the beginning of the year we’ve realized that for the first time the legal precedent exists to be able to go after multiple John Does at the same time, and also to obtain their information through the ISPs.

Once we made the porn studios aware that we might be able to assist them, it was basically the beginning and end of our marketing effort, because quite frankly I doubt I go three days without a studio asking us to work with them. We haven’t made a call to a studio since the first week that we started working on this project.

What is your strategy with respect to naming alleged infringers publicly?

Well, as you know, we are only naming people in the lawsuits as anonymous John Does. We don’t put any person’s real name in there until it becomes apparent that we can’t work anything out. My attitude is, let’s try to resolve this with the least amount of litigious behavior. I was just speaking to someone yesterday and he said, ‘Look, I want to resolve this, I work with the Boy Scouts, I didn’t download anything inappropriate or illegal.’ He didn’t want to deal with the problem and have to hire an attorney, and we were able to resolve the issue and come to a resolution. In that case, no one is ever going to know his name other than our staff, and we much prefer that, because we don’t think anyone is served by losing their job or being ridiculed or whatever.

At the same time, if our clients have had content stolen from them and they lost money because of it, we have to protect their rights. I think it’s a balancing act between making sure people are not embarrassed but also make sure our clients don’t go out of business, because it’s a free-for-all right now on the internet.

Do you recognize that there are some people in the industry who don’t agree with the tactic of suing people who watch porn, using basically the same argument the music industry faced when it started suing illegal downloaders?

Yes, of course, I’ve heard this argument made a lot, but I have to respectfully disagree with the people who say we’re going after [the industry’s] customers. People who are very comfortable using BitTorrent and taking content for free are not going to ever pay for it. Our research is very clear on that point.

Our argument is very basic. We believe that using Torrent sites to watch copyrighted content is theft, and we are just going after the people who do that so they can compensate our clients for stealing something. It’s like we’re going after a car thief. We don’t care that it’s a car that’s a certain color or brand; we’re going after him because he stole a car.

There are also a lot of people in the mainstream who don’t believe in going after end-users, because it somehow lessens the freedoms inherent in the internet.

In fact, it is by allowing pirates to simply bankrupt or at least cripple this entire industry that reduces freedoms by preventing the law-abiding citizen from getting access to content. At this rate there won’t be any high quality, high-definition porn, but only recycled stuff from the 80s and 90s, because it will no longer worth it to make new movies.

What about the claim that was made in the Yahoo! News article that implied you want to shame illegal downloaders publicly for the type of content they are watching as part of the strategy to get them to settle?

I think it’s muddying the water to say that we’re trying to shame someone; it’s an effort to take people’s eye off the ball, because at the end of the day unless you can confuse people it boils down to the fact that someone stole something that wasn’t theirs. And that’s something that I think people can understand, and certainly so far the judges have no problem understanding that. Quite frankly, I’m surprised at how fair the judges have been. I have absolutely never felt in any of these cases that the judges were not giving us the full protection of the law because of who we happened to represent.

Here’s how we look at the issue. Some of our producers make content that some people may not feel is mainstream content, such as transsexual content. But our clients believe in their content. They’re not embarrassed by the fact that they make it, and they’re certainly not embarrassed that people come and pay them for it. But I do think that any upstanding citizen would and should be embarrassed to go into federal court to defend illegally downloading Titanic, because he committed a crime and if he gets a judgment against him and works at a bank or for the government, he could have trouble at his job. So there’s always an embarrassment factor when you’re caught breaking the law and that’s what we’re going after.

In the larger sense, I can’t speak to what a downloader may or may not feel embarrassed about because when I download porn I’m not embarrassed about it at all. I did it, I want to watch it and if you don’t like it, well, I guess you don’t have to be my friend. I would be personally offended if someone were to come to me and say, John, you can’t watch transsexual content. Excuse me, but we’re in the United States. I want people to have complete freedom.

I just think it’s important to get back to the basic issue here. We have to prove that these people stole something. If we make an allegation in federal court that we have no way of proving, we’re going to get in a lot of trouble. So the accused is defending himself on an action that we have a lot of evidence that he did. If he’s that embarrassed about downloading porn, then maybe he shouldn't do it, but that’s a separate issue. The fact is, I don’t care what he downloaded. If he downloaded Rosetta Stone to learn to speak Spanish; if he downloaded Titanic; if he downloaded transsexual porn; if he did any of these downloads illegally and he’s caught, he should be punished according to the U.S. Copyright statutes.

In light of your success in the courtroom thus far, do you expect to hear from any mainstream studios?

We actually have received a couple of calls from studios out in California, but we’re not sure if we’re going to go in that direction. We are very busy right now with the clients we have, and I’ve always believed it’s dangerous to worry about your next client and not about your current client. But yes, our technology would allow us to go after any illegal downloader of anything, and the only limiting factor would be our ability to scale up.

So why do you think some law firms—like the one litigating The Hurt Locker case—are having more difficulties than you are? A federal judge in South Dakota just blocked their attempt to get information from ISPs in the state. 

A part of that may have been about how they went about doing it. Litigation doesn’t have to be about shouting at one another and being hostile. If you go to third parties that are just trying to make money providing internet service or whatever, and you act like a jerk with them, they may not like that. We try to work with third parties and don’t see the upside in threatening them or throwing lawsuits around at the people we need as partners in this. I mean, I don’t think ISPs want to be a conduit to massive bandwidth usage for illegal purposes because they would then have to increase their infrastructure. Illegal downloaders hurt ISPs as much as anyone else. So we point that out to them, and say, if you lose one tenth of one percent of the people who are mad because we’re suing them, you’re also going to get rid of 80 percent of your client problems, at which point you can send us a thank you card.

LAS VEGAS—The International Lingerie Show concluded its three-day run Wednesday at the Rio Hotel and Casino, where attendees buzzed about new products and lines from up-and-coming and established brands alike.

CYBERSPACE—A just-released study conducted by a husband-and-wife team of psychologists found that porn searches surge following national elections in states that voted for the winning candidate. The researchers are not particularly sure why that happens, but they thought the results were interesting enough to have them published on the Evolution and Human Behavior website.

The abstract on the site reads, “The current study examined whether or not individuals who vicariously win a competition seek out pornography relatively more often than individuals who vicariously lose a competition. By examining a portion of Google keyword searches during the 2004, 2006 and 2008 US election cycles, the relative popularity of online pornography keywords searches was computed for each state and the District of Columbia the week before and the week after each election.

“Consistent with the Challenge Hypothesis, following all three election cycles, individuals located in states voting for the winning political party tended to search for pornography keywords relatively more often than individuals residing in states voting for the losing political party.”

“We don't know for sure if testosterone is the reason why we are seeing these changes in porn-seeking behavior, but it seems like the best explanation at the moment,” said Villanova University’s Patrick Markey, who worked on the study with his wife, Charlotte Markey of Rutgers University.

“If we saw this just for one election, you might chalk it up to chance, but we saw a pattern with it happening three times,” Markey told LiveScience.com. "It's also cool that we saw these results with both Republicans and Democrats—that these were general results not just driven by one political party."

The researchers had devised the study after looking at past research showing that people who win or lose in competitions often experience a respective surge or drop in testosterone.

“Such changes are seen even if the people are only spectators of contests,” reported Live Science. “For instance, while men typically show a slight nighttime drop in testosterone levels, male voters for Sen. John McCain showed a larger testosterone drop than normal during the 2008 U.S. presidential election, while those of male voters for Sen. Barack Obama kept steady.”

The Markeys then postulated that men who voted for winning candidates might likewise experience a desire for sexual stimulation. They focused their study on internet searches, where up to 25 percent of daily searches are for porn-related keywords, and men make up a vast majority of visitors to porn sites.

They used Google to configure their search patters and results, and “looked up the popularity of pornography searches in ‘red’ and ‘blue’ states—those voting for Republicans and Democrats, respectively—in the week before and the week after the 2004 and 2008 presidential elections and the 2006 midterm elections.”

While unsure exactly why the results turned out the way they did, the researchers addressed the obvious suggestion that maybe winners are simply happy and thus more prone to seeking out other pleasurable stimuli, like sex. Unfortunately, there is no correlation between happiness and sex. In fact, according to Patrick Markey, research shows that they are often mutually exclusive.

"This is probably because for some people, sex is something we do not do to celebrate our moods but to change them—when we are sad, we have sex to make ourselves happy," he said.

MARTINSBURG, W. Va.—Another series of “John Doe” copyright infringement lawsuits was filed Sept. 24 by a single attorney on behalf of four adult studios.

Kenneth .J. Ford of the Martinsburg, W. Va.-based Law Office of Kenneth J. Ford filed the lawsuits in federal court in West Virginia on behalf of West Coast Productions, Combat Zone, Third World Media and Patrick Collins, Inc.

Though the complaints are as yet unavailable, the number of anonymous defendants being sued is apparently in excess of 5,000, an amount that adds significantly to the total number of John Does sued by adult studios in just the past month.

It is expected that more such lawsuits will be filed in the very near future in courthouses around the country, by producers who share the common complaint that BitTorrent users are engaged in the unauthorized viewing of copyrighted content. The plaintiffs in these cases are seeking to identify the anonymous users through subpoenas issued to their internet service providers.

STOCKHOLM, Sweden—Three out of four defendants made it to the Svea Court of Appeal in Sweden this morning for the start of The Pirate Bay (TPB) appeal proceedings. The mother of Gottfrid Svartholm, one of four defendants, said her son was stuck in a Cambodia hospital, too sick to attend the trial. The others—Peter Sunde, Carl Lundstrom and Fredrik Neij—made it into court.

Last year, the four defendants were found guilty of being accessories to breaching copyright laws, and each face one-year prison sentences and fines of 30 million kronor ($4.4 million) if the appeal is unsuccessful.

Even though Svartholm was not present, the judge said the trial could continue as long as long as Svartholm’s attorney provides a doctor’s certificate by Oct. 7 saying he is too sick to attend. With that, a rather uneventful day went ahead in a trial expected to last until Oct. 15.

According to news accounts, today’s proceedings were taken up with a technical description of how The Pirate Bay works, and also a history provided by Prosecutor Håkan Roswall of how it began in 2003, eventually growing to become a dominant file-sharing site. The Pirate Bay was forced to move its servers out of Sweden in 2005 after it was learned that a new Swedish law was about to be passed that would make the site illegal.

“Options in Russia and Argentina were considered but not taken up. Roswall also said it was of interest that Lundström had made enquiries around that time in respect of setting up a company in Argentina,” reported Torrent Freak. “Roswall claimed that in 2006, hosting company PRQ signed contracts with Rix Telecom—before this event The Pirate Bay hadn’t paid anything to Rix. The finances of TPB improved and eventually it partnered with an Israeli company to assist with advertising. He says that Carl Lundstrom, Gottfrid and Fredrik received revenue from these ads.”

Roswell provided other documentation intended to prove the working connections between the defendants, the revenue that was being produced and policies in place that not only discouraged but mocked attempts by copyright holders to get their content removed from The Pirate Bay.

Tomorrow, reported Torrent Freak, “the prosecution will go over the evidence against Fredrik Neij.”

WEST HOLLYWOOD, Calif.—"Porn makes me feel really beautiful. It makes me feel really sexy and really confident. It makes me love myself."

That was one of the thoughts offered by Oriana Small, aka former AVN Female Performer of the Year Ashley Blue, during a panel discussion Sunday afternoon at the 2010 West Hollywood Book Fair entitled "Let's Talk About Sex: Porn, Erotica and Everything in Between." Small appeared on the panel in promotion of the photo anthology Anal Sex Love, just released through Edition Reuss, featuring her and shot by husband Dave Naz, and her own autobiography, Girlvert: A Porno Memoir, due for digital release in December and in print at the beginning of 2011 from Barnacle.

The panel was moderated by Rachel Resnick (Love, Junkie) and also featured authors Larry Duplechan (Got 'til it's Gone), Adrian Colesberry (How to Make Love to Adrian Colesberry) and Penthouse editor Rachel Kramer Bussel (Best Sex Writing 2010). 

Those who've followed Small/Blue's career will of course recognize the Girlvert moniker as that of her signature character from the long-running JM Productions series of the same name. A winner of multiple AVN Awards, Girlvert has largely drawn upon Small's real-life experiences as the bases for the character's continuing adventures in havoc-wreaking. Now the girl behind the character will be sharing some of those experiences with the world.

One she shared during Sunday's panel was her first attempt at having anal sex, something she said she was inspired to try at the age of 16 or 17 after reading Henry Miller's Under the Roofs of Paris. "I had this boyfriend and I took him in my room and just told him, 'I want you to put it in my butt,'" she said. "I passed out, because he just shoved it in. I just blacked out because it hurt so bad."

Asked how she defines the word "perversion," Small mused, "'Perversion' is not a negative word to me. It's cool. I don't draw any lines ... I draw them as I go. But they're not solid lines. They're broken lines."

This followed her proclamation that, "I get really disappointed when things are not dirty enough in a book. I feel like it's insulting to my threshhold. I like looking at gross things. I like things that are violent and interesting. I want to hear the tasty expressions, like 'wizard sleeve,'" (which she explained is a term for a bedraggled vagina).

"It was because of porn that I got this way, and I'm grateful for it," she said.

CANOGA PARK, Calif.—Free Speech Coalition (FSC) has announced that Pink Visual has donated the website design and URL address for FSCAPAP.com, the new information website for FSC’s Anti-Piracy Action Program (APAP).

The website has been launched in advance of the Content Protection Retreat to be held Oct 17-19 in Tucson, Ariz., hosted by Pink Visual. Co-sponsors of the show include FSC, Hustler, Titan Media and SeanCody.com.

There will be an APAP presentation for attendees at the retreat.

"After learning more about the state-of-the-art technology behind the FSC’s anti-piracy program and the incredible package they created to make this a feasible program for virtually any studio, we at Pink Visual felt donating the website design and domain was a minimal token of our appreciation," said Pink Visual President Allison Vivas.

"We hope other companies may be able to see simple opportunities like this to donate even non-monetary items to industry organizations like the FSC,” Vivas added.

Both content producers and tube site operators can visit the site for an overview of APAP’s options to protect digital content and minimize incidents of infringement.   

With APAP, producers can utilize fingerprinting and spidering technology to track their content, and have access to legal and copyright counseling, as well as content monetization options.

Tube site operators can create revenue by replacing illegal video clips with promotional content. DMCA compliance and legal counseling also are available to tube operators that register with APAP.

Both content producers and tube site operators can register at the new site, to be contacted by an APAP representative.

“We are exceedingly grateful to Pink Visual for their support and expertise in developing this website,” FSC Executive Director Diane Duke said. “APAP is an innovative program—only one of several projects that FSC has undertaken to support the industry. PAUL, Minn.—One would think that residents of St. Paul would relish not just the idea but also the fact of having an actual brick-and-mortar adult bookshop to help warm the heart’s cockles during the long frigid nights ... and other sorts of cockles, too. But considering St. Paul’s reputation as the conservative of the twin cities, the end of this particular era isn’t such a surprise.

The neighborhood surrounding Denmark was gentrifying, anyway, making Denmark Books not just a novelty—in the original sense of the word—but also kind of an eyesore, especially to some of the neighbors. The landlord told TwinCities.com that the now-gutted store’s time had come.

“It's always kind of been a yin-yang thing—we have the yoga center and then the porn bookstore," said Jeff Austin. "I think in the end, it's kind of good for the neighborhood that it's gone. It's the direction that West Seventh is going in."

Austin himself would like to see a health food restaurant or deli move in to complement the yoga parlor. Apparently sex, which is only aided by immersive exercise regimes like yoga, is not considered as complementary, though Austin said the yoga patrons had no issues with the store.

Still, according to Marc Shulze, who bought the business three years ago, both the stress of running a store whose clientele was moving online and also the hassle of dealing with some of the toughest zoning laws in the state eventually necessitated the decision to shutter.

“The economy was just getting rough," said Shulze, 26, explaining the store’s steady decline in sales. "It just wasn't working anymore. The internet was huge competition. People can go online, pay $10 a month and get unlimited access.”

As far as picking up again, Shulze said he’d have to think long and hard about it even though he loved what he did.

"I know I'm not going to open up another store for a while, if ever. It was a great place to work, because there's really no other occupation where you get paid to sit around and talk about sex all day. But in a way, I'm glad to see it gone," he said. "All the stress of running around and managing employees was getting to me. St. Paul is just so ridiculous with their adult laws. I don't even want to deal with it anymore."

Restrictive laws have also put the kibosh on most of the city’s strip clubs, too, according to TwinCities.com.

“In St. Paul, the only place where women are legally permitted to go [au natural] for cash anymore is the Lamplighter Lounge on Larpenteur Avenue, and there only behind protective stage glass, without ever making physical contact with patrons. Men push tips through a drawer,” wrote Frederick Melo. “Some say that's hardly a surprise, with so much going digital and finding root on the Internet. Others say the naughty clubs and novelty stores have just moved to Minneapolis, where more permissive zoning allows a cluster of such establishments in or near downtown, an area home to 17 adult-themed bars, clubs and entertainment sites.”

It looks as if St. Paul won’t have to worry about those long cold nights as long as its twin is taking care of business. That’s scant solace for Denmark Books, however—the last of its kind.

One Week Left for 2011 AVN Awards Pre-Nom Submissions

CHATSWORTH, Calif.—The pre-nomination site for the 2011 AVN Awards Show closes at 5 p.m. this Friday, Oct. 1. Producers, manufacturers and retailers should immediately request access to the site in order to submit their movies, products, outlets and other entities for awards consideration.

The 28th AVN Awards Show is scheduled for Jan. 8 at the Pearl Concert Theatre inside the Palms Casino Resort in Las Vegas. This year, for the first time, the AVN Awards will include categories honoring adult retailers, distributors and novelty manufacturers.

In order to be eligible for a 2011 award nomination, a movie or product must be released by Sept. 30. To qualify for consideration, it must be in stock with either 10 wholesale distributors or 100 retail stores. The eligibility period includes any movie or product released between Oct. 1, 2009 and Sept. 30, 2010.

To access the pre-nom site, candidates must first establish a user account on AVN.com (if they do not already have one) by entering their email address at this link: https://secure.avn.com/account/register/. Once you submit the form a confirmation email will be sent to you at the address you entered. You must click the link in the confirmation email to activate your account.

Once you have an activated AVN.com user account, you must request access to the pre-nomination site by clicking this link:

Users will be notified of their access with an email. If approved for access, they also will be provided a link in this email to the secret pre-nom site address. 

Once a password is activated, you can go to the site as many times as necessary, but there will be no extensions of the deadline.

AVN asks producers and manufacturers to be judicious in their pre-noms, submitting only those titles and items they strongly believe have a chance at being nominated rather than submitting all product released during the eligibility period.

Production companies must supply AVN with all pertinent information in their pre-nom entries, including the full stage names of all the performers in the sex scenes and the names of all the behind-the-camera professionals in the technical categories such as editing, cinematography, music and others.

By Oct. 1, AVN asks that producers send two (2) DVD copies of each movie or series it would like considered, as well as sample materials used in marketing campaigns if seeking consideration in those categories. Novelty companies should also provide two (2) samples of each product they would like considered. All items should be mailed or hand-delivered to:

CYBERSPACE—Last week, Larry Flynt Internet Group filed a lawsuit in a Dallas federal court against 635 anonymous individuals the company says it can prove engaged in a coordinated effort to unlawfully reproduce and distribute Hustler's "copyrighted motion picture, Barely Legal School Girls: No. 6, by means of file transfer technology called, BitTorrent."

It and other recent cases reveal a significant rise in the number of producers willing to target BitTorrent users, and demonstrate their unambiguous embrace of an approach the industry has thus far by and large avoided.

Tuesday, another lawsuit was filed in Dallas by Evan Stone, the same attorney who filed on behalf of Flynt Internet, accusing 670 Does of the same offenses on behalf of Mick Haig Productions, which owns the copyright to the adult German film Der Gute Onkel.

"With [Haig's] additional 670 lawsuits, the total number of copyright complaints focusing on adult movies now totals over 2,200," reported Slyck News. The Haig and Flynt Internet cases were preceded by other notable lawsuits targeting Does, including concurrent filings by Lightspeed Media Corporation, Millenium TGA and Hard Drive Productions.

The new offensive apparently also includes an element unavailable to those in the mainstream: the embarrassment factor. According to AFP, in an article posted to Yahoo! ISPs subpoenaed by Lightspeed include Comcast Cable, Bell South, RoadRinner, Verizon and Sprint, among others.

The Lightspeed Order highlights the different experience the adult producers are having from that of the attorneys in the massive U.S. Copyright Group lawsuit filed in the District of Columbia against thousands of “John Doe” defendants accused of illegally downloading The Hurt Locker. "Piracy on the internet is much more available to the average user than it ever was," he said. "The technology has outpaced the laws. We really need to organize ourselves and lobby for a change in the law," he added, referring to the Digital Millenium Copyright Act.

SAN FRANCISCO—While the theme of the 2010 GayVN Awards was “Prison Break,” the talent from big-name studios was breaking out all over as the trophies were handed out for during the ceremony Friday, Sept. 24, at the historic Castro Theatre.

Comedian Alec Mapa, who arrived with his own towering "security guard," served as warden/host of the event, which was presented by NakedSword. Mapa pulled no punches during his on-stage antics, going so far as to demonstrate great sex positions with Diesel Washington and even taking pot shots at mainstream celebrities.
