Debate on the merits of .XXX can be heard on CBC radio July 1

TORONTO—Wednesday morning, Free Speech Coalition (FSC) Executive Director Diane Duke engaged in a radio debate with ICM Registry CEO Stuart Lawley and Canadian feminist Susan Cole, the senior entertainment editor for Canada’s NOW magazine, about ICM’s application to run a .XXX sTLD.

The debate was moderated by Piya Chattopadhyay for Canada's national public broadcasting show The Current, to be broadcast on CBC Radio. It explored the issue of a .XXX sTLD from three perspectives: that of ICM as the sTLD applicant, the adult entertainment industry as the targeted sponsorship community, and from a feminist perspective on the societal impact of the proposed sTLD.

The first to be interviewed was Lawley, who touted that .XXX would be a TLD for the “responsible” adult entertainment community. Although he stressed that he believed the top-level domain would be financially advantageous for the adult entertainment community, Lawley also reported that ICM is expected to make between $30 million and $150 million a year off of the adult entertainment industry with this endeavor.

Duke, the second to be interviewed, pointed out that the adult entertainment community is concerned at the potential to mandate the sTLD, making the industry an easy target for anti-adult industry extremists. She also pointed out that with an sTLD, many adult businesses would be forced to defensively register their domain names to protect their brand and traffic. She acknowledged that the ICM CEO had mentioned the option to pay a one-time fee to “park” a domain, thus protecting brand and traffic. 

“In our initial discussions Stuart talked about a price of $25," she said. "Monday, I read somewhere that the price was between $50 and $250. And by Tuesday, a reporter I spoke with said that it was up to $275.”

Duke stressed that an industry hard hit by the recession and copyright infringement does not have the expendable income to invest in defensive registrations. Finally, Duke spoke of the regulatory board associated with ICM’s application.

“The nominating process and ultimate make-up of the board is still unclear,” she said. "To have a company that is not part of the adult industry oversee the regulation of our industry is simply untenable.”

Cole was asked if she thought that the sTLD should be mandated and all adult businesses be forced to have a .XXX TLD. She said that she believed that it should, that by mandating adult businesses viewers surfing the internet would not accidentally stumble on to porn sites.

Duke, identifying herself as a feminist and longtime advocate for women’s rights, said that she was surprised that Cole would take that stand knowing, from a feminist perspective, the dangers of marginalizing a community and limiting their right for free expression.

Cole’s response was that Canada does not have a First Amendment and does not hold free speech in the same esteem as those in the U.S.

WordPress is an open source content management system. It has many features including a plug-in architecture and a templating system. Used by over 300 of the 10,000 biggest websites, WordPress is the most popular blogging software in use today. As of September 2009, it was being used by 202 million websites worldwide.

RTA was developed by ASACP out of a need for a free, easy to use, and internationally recognized label that designates content for adults only. The RTA label is a unique string of “meta data” which can be inserted into the computer code of any website. The lawsuit contains six charges related to 19 sites Victory believes infringes their trademark

LOS ANGELES—eXXXotica parent company Victory Tradeshow Management has filed suit against Adultcon’s corporate parent, alleging that the later has surreptitiously registered domain names that infringe upon its registered trademark.

The complaint, filed yesterday by Victory Tradeshow attorney Michael Fattorosi in U.S. District Court in Los Angeles, alleges that Adultcon parent, Live Entertainment, registered 19 websites that infringe upon its registered trademark of “eXXXotica” thus causing confusion in the marketplace between the two shows.

The six counts detailed in the complaint allege trademark infringement and dilution, unfair competition and cybersquatting. All 19 domain names in question redirect to Adultcon.com.

According to the complaint, Victory has been using the name eXXXotica since March 6, 2006, and obtained a trademark for the term on Oct. 14, 2008. The suit states that Adultcon purposely registered said sites using the term eXXXotica and other confusingly similar titles to divert business away from Victory.

“[Adultcon’s] registration and redirection of web sites containing [eXXXotica] is a deliberate attempt to trade on [Victory Tradeshow’s] goodwill and the prestige of [its] products and services,” the complaint states. “[Adultcon’s] conduct has caused, and will continue to cause significant damages, including lost sales and profits, and irreparable harm to [Victory Tradeshow].”

The domain names mentioned in the suit are Exxxotica-lv.com, ExxxoticaExpo-LA.com, ExxxoticaExpo-LV.com, ExxxoticaExpoLA.com, ExxxoticaExpoLV.com, ExxxoticaLA.com, ExxxoticaLasVegas.com, ExxxoticaLosAngeles.com, Exxxoticalv.com; ExxxoticaVegas.com; ExoticaExpo-LA.com, ExoticaExpo-LV.com, ExoticaExpoLA.com, ExoticaExpoLV.com, ExoticaLA.com, ExoticaLosAngeles.com, ExoticaLV.com, ExoticavaLasVegas.com and ExoticaVegas.com.

The suit seeks damages of up to $100,000 per domain name, attorney's fees and a jury trial.

Adultcon has operated 18 fan shows at the Los Angeles Convention Center in downtown L.A. and also produces a similar show in Las Vegas.

eXXXotica has produced five events in Miami at the Miami Beach Convention Center and two years ago expanded into New Jersey.

Adultcon principal Renaud West declined comment to AVN last night saying that he hadn’t yet been served with the complaint. Victory Tradeshow attorney Michael Fattorosi also declined comment citing pending litigation.

QUINCY, Mass.—An enlightened city official from Quincy has offered a time-honored method to discourage adult patrons from accessing pornography at public libraries. He wants to make public a list of offenders.

Ward 2 Councilor Daniel Raymondi said that his main concern is whether any of the patrons violating library policy by accessing online porn are sex offenders. City officials passed an ordinance in December banning all Level 3 sex offenders from public libraries and parks.

“We’re just trying to get ahead of it,” said the councilor. “I can’t imagine your average taxpayer thinking it’s okay to satisfy the appetites of some of these folks by using public dollars.”

It is unclear whether the idea that non-sex offenders might also want to access porn has occurred to Raymondi, who sent a resolution to the mayor requesting “a list of the individuals who violated the library’s policy against viewing pornographic material within the past year.”

The city’s legal team will need to assess the request before complying with it, but libraries in the city already have a three-strike rule for patrons caught snooping at dirty pictures.

At least Raymondi is not proposing that offenders be tarred and feathered or kept in stocks, as he might have done in the 1700s—or worse, burned at the stake. It’s 2010, after all, and this is Massachusetts we’re talking about, not Texas.

CHICAGO—Playboy today announced that it was cutting more staff in an effort to save the operation millions annually.

Playboy CEO Scott Flanders said in a conference call that the company would save more than $3 million per year by slashing jobs and reducing overhead. The company has cut close to 100 jobs since last year.

TheWrap.com reports that the cuts will come from the “high-ranking, highly-paid corporate executive” ranks.

“The downsizing announced today is not a reflection of our employees' talents and work ethic,” Flanders said, “but rather due to the overall change in the company's strategic direction.”

That strategic direction includes continuing to transition Playboy from a media company to a licensing outfit looking to slap the ubiquitous bunny-eared logo onto as many consumer goods as possible.

"Our goal is to transition Playboy to a brand management company and, in so doing, to more cost-effectively monetize our powerful brand and assets,” Flanders said. “As we proceed through this transformation, we are aggressively looking for opportunities to streamline our operations, consolidate functions and reduce overhead expense.”

Last month, Playboy reported that the company’s overall revenues declined 10.8 percent from the first quarter of this year compared to the same quarter last year.

LOS ANGELES—Those who showed up at the Cal/OSHA Advisory Meeting on Bloodborne Pathogens in the Adult Film Industry today expecting a discussion of whether condoms should be mandated in adult movies were in for a surprise: According to both Cal/OSHA inspector Deborah Gold and agency attorney Amy Martin, condoms are already required for sex scenes, and any production that doesn't use them is breaking the law.

"I'd just like to make something very clear," Gold said at one point. "Right now, the standard mandates the use of condoms, so people who have come here and think that we're arguing about whether we're going to mandate the use of condoms need to understand that the current status quo is that if there's blood or other potentially infectious material, you need to prevent contact with that and the employee's eyes, skin, so people just need to understand that—I know people keep talking about it as though we're thinking about newly mandating condoms and people have to understand that what we're trying to do is talk about whether something new can be worked out in the standards that would protect employees as well as what's currently the present."

However, that comment, which came after more than an hour of discussion, hardly served to limit the subjects that attendees wanted to talk about.

More than 100 people crowded in meeting room 1-040A at the Cal/Trans Building in downtown L.A. beginning at 10 a.m. for a wide-ranging discussion about health issues in the adult performer community. Attendees with adult industry ties included performers Nina Hartley, Joanna Angel, Jeremy Steele, Eric John, Christian XXX, Anita Cannibal, Angela Aspen, Ben English and Dave Cummings; Free Speech Coalition executive director Diane Duke with FSC attorneys Kevin Bland and Karen Tynan; FSC board chair Jeffrey Douglas and Membership Director Joanne Cachapero; Wicked Pictures Vice-President (and FSC treasurer) Joy King; attorney Michael Fattorosi; Girlfriends Films owner Dan Johnson and Marketing Director Moose; Immoral Productions president Dan Leal; Protecting Adult Welfare founder Bill Margold and Dr. Eric Aronow of Adult Industry Medical Healthcare Foundation (AIM).

Also attending were AIDS Healthcare Foundation president Michael Weinstein and staffers Whitney Engeran, Brian Chase and several others; Dr. Paula Tavrow and others from UCLA's Reproductive Health Interest Group; Drs. Peter Kerndt and Robert Kim-Farley of the Los Angeles County Department of Public Health; and Shelley Lubben and several associates of her Pink Cross Foundation.

After an introduction by Gold, who gave a short history of the Occupational Safety and Health Administration (OSHA) at the federal and state levels, noting that California's first "bloodborne pathogen" (BBP) regulations were first enacted in 1990. She also said that the purpose of today's meeting was to discuss the possibility of changing the state's BBP regulations, which she noted would also have to be justified at the federal level, but she was careful to point out that Cal/OSHA is not at the "formal rule-making stage" yet.

Gold then introduced Dr. Kim-Farley, who gave a Powerpoint presentation about sexually transmitted diseases (STDs) in the adult industry, stating that "STDs are common among AFI [adult film industry] performers." He listed the various types of STDs and how they are transmitted, noting that one method of transmission which has a "moderate" probability of passing along STDs is "skin-to-skin contact." He also attempted to debunk some "myths" regarding STDs in the industry, including, "Screening does not prevent infection," that "Testing makes people safer" and that "Sharing performer test results ensures a clean bill of health."

 Dr. Kim-Farley also claimed that according to the Health Department, there were 3,200 chlamydia and gonorrhea infections among the performer community between 2004 and 2008, and that 25 percent of talent get infected with an STD each year—figures that Dr. Eric Aronow of AIM disputed, suggesting that most were a result of duplicate reporting, and indeed, Dr. Kerndt admitted that for STDs like chlamydia and gonorrhea, tests conducted even three weeks after the person was cured could show residual infection, but he claimed that the Health Department was aware of that situation and discounted such reports from its statistics.

Dr. Kim-Farley also reported that there had been eight HIV cases among performers since 2004, though when Dr. Kerndt was asked to elaborate on that figure, he agreed that only four cases—that of Darren James and the three actresses he infected—could be traced to actual performers. Nonetheless, Weinstein repeated the claim that 22 performers had been infected since 2004—a figure that has been debunked even by the Health Department.

At one point, Dr. Kerndt was asked to compare the number of HIV cases in the performer community with the number reported in the general population, which he stated were about 100 to 125 new infections per month in Los Angeles. Also, in response to an objection raised by Nina Hartley, that prolonged use of condoms in sex scenes caused vaginal abrasions, Dr. Kerndt stated that he had never seen any studies documenting that happening.

Dr. Aronow gave a brief overview of AIM's testing procedures, and hoped that one outcome of the meeting would be to come up with a set of testing protocols that would be acceptable to Cal/OSHA.

After a lunch break, the bulk of the afternoon discussion dealt with condoms: How extensive is their use in the industry, and various reactions to condom use by both industry members and health care professionals.

PARIS—Le Monde, the famed but struggling French newspaper, has accepted the offer of a trio of investors, one of whom made his fortune in online porn. In agreeing to the sale, the paper snubbed the country’s president, Nicolas Sarkozy, who had pressured the paper’s staff to reject the offer tendered by Yves Saint Laurent Group partner Pierre Berge, Lazard Ltd. banker Matthieu Pigasse and internet billionaire Xavier Niel, whose initial career involved running sex-chat services.

According to Bloomberg, Sarkozy opposed the deal because “Berge backed opposition Socialist Party candidate Segolene Royal in the 2007 presidential election and is close to International Monetary Fund head Dominique Strauss-Kahn, a possible 2012 candidate for the Socialists.” Pigasse also is reported to be a supporter of France’s Socialist Party, a fact that only further fueled Sarkozy’s fury.

But it is Niel’s porn past that also is garnering a fair share of the headlines, with some papers speculating that the controversy created by this transaction could rival that of the purchase of the Daily Mail by Richard Desmond, who made millions from since-sold adult magazines.

According to the Guardian, Niel, 42, “made his first serious money when he was in his teens, launching a ‘sexual contact’ agency on Minitel, an early forerunner of the internet launched by the French post office that allowed users to send electronic messages over phone lines. Niel then branched out into peep shows, before building a hugely successful internet business called lliad, a French equivalent of Freeserve that was the first to offer free access to the internet.”

In 2006, he also was sentenced to a two-year suspended sentence for embezzlement, and the Guardian contends that his interest in Le Monde may be motivated by an interest in embarrassing powerful figures like Sarkozy. Considering the pasts of all three investors, therefore, it’s easy to see why the French president lobbied so heavily against the sale, and why, perhaps, the sale was approved by Le Monde’s journalists, who account for the largest stake holding group in the paper.

The trio reportedly bid $135 million (110 million euros) for the paper.

LOS ANGELES—When it comes to getting an edge over competing performers for roles, there are many things an adult actor can do. Cosmetic enhancements and gym workouts certainly help. But Jack Lawrence undertook a different kind of makeover: He refurbished a police car.

Now, when directors hire Lawrence to portray a cop—something he’s done in more than 200 movies—the veteran adult performer can bring his own wheels.

The black-and-white Ford Crown Victoria has working sirens and looks just like the real thing from the inside out. Lawrence told AVN that he purchased the car with the intention of giving something back to the industry. The vehicle has already been used in at least four different shoots.

“I was complaining that there’s not much work any more, and my mentor told me, ‘Don’t wish for more wind—build a bigger sail,’” said Lawrence, who is in his eighth year in adult with 762 movie credits on his résumé.

“So I did Botox, hit the gym harder and started working on my career. I’ve done probably 200 shoots as a police officer, so I thought heck, if I did this that’d give me some work. It usually costs $600 a day to rent a police car. I thought, ‘Why not acquire one and spend my time and energy working on it, and producers can get it from me for good prices?’ I put the labor in to have something I can bring to set and increase everyone’s production value.”

When Lawrence bought the car it only had a spotlight and a cage.

“All the lighting and the other stuff I did from scratch,” he said.

In a YouTube video, Lawrence explains all the features on the vehicle, including eight-way strobes, an operational siren, spotlights, operational radar, dashboard lights and a full cage. He can transform the car in a matter of minutes by placing a “Sheriff” sticker on the bumper, a K9 sticker, or switching out the division and group numbers on the trunk and roof. In the front seat he even has an authentic ticket book and police computer.

“I think one of the main purposes of porn is to create a fantasy, and one of the most important parts of fantasy is to suspend disbelief for as long as possible,” he said.

Lawrence’s clean-cut, muscular appearance helps him inhabit the many cop roles that come his way—such as a scene in Tom Byron Pictures’ All Natural Nurses where Lawrence gets to nail Sara Stone while on the job.

Lawrence has also worked the goofiest end of the law enforcement spectrum, doing a spot-on impersonation of the micro-shorts-wearing Lt. Dangle in New Sensations’ Reno 911 XXX.

More recently Lawrence wrapped Hustler's This Ain't Cops XXX, and he’ll be donning a uniform in at least six more productions this summer.

“I’m getting paid to do something that’s really fun,” Lawrence says. “And in these times I feel you have to give something back to the industry. You can’t just sit there and just expect a check without doing something.”

A native of Oregon and the San Francisco Bay Area, Lawrence is also the most prolific parody actor in the business, with 24 credits, including the Professor in This Ain’t Gilligan’s Island XXX and Ralph Malph in This Ain’t Happy Days XXX, both from Hustler.

“I got into the porn but after a couple years I found out I enjoyed the acting aspect. I guess I just have a bland face that makes me look like a lot of different people," Lawrence said. "And I don’t take myself seriously."

When he’s not impersonating a peace officer, Lawrence guest lectures for a human sexuality class at College of the Canyons taught by Michelle Labrie, a professor of psychology. Lawrence talks to the students about prostitution and pornography.

CHATSWORTH, Calif.—Comeback cocksman Dale DaBone is blaming himself for the prescription drug overdose tennis star Jennifer Capriati suffered Sunday. At least in part.

In a report from TMZ, DaBone said that Capriati was prone to depression during major tennis matches—and Sunday, Wimbledon was taking place. DaBone would know this about Capriati because he dated her from 2003 to 2009, during which time he stopped performing in porn. And he believes that his recent decision to get back into the game (he just made his big return in Vivid Entertainment's Batman XXX: A Porn Parody) played a substantial role in pushing her over the edge.

DaBone spoke at length about his relationship with Capriati several weeks ago in an exclusive interview with AVN Live, in which he revealed that his decision to leave the business was largely due to his blossoming romance with her, and that his porn past was ultimately what caused that romance to crumble.

"This is a life sentence," DaBone said in the interview. "It's a bed that we made that we have to lay in."

Group will promote safe sex on college campuses and at Hustler Hollywood stores

BEVERLY HILLS—Dozens of porn fans and other Angelenos gathered Saturday night at the Hustler Hollywood store on Sunset Boulevard to witness the first in a series of events sponsored by the Association for Safe Fun Sex (ASFX), an activist group whose message is that "safe sex doesn't have to be boring sex," according to ASFX publicist Tyler Barnett.

Also on board for the festivities were adult novelty manufacturer/retailer Screaming O, which brought its own d.j. and plenty of novelties for attendees to check out, and the Hustler Hollywood chain itself, which will provide space at its stores nationwide for future ASFX/Screaming O events. Saturday's event included prizes (including giveaways of the Screaming O Vibrating Condom Pack), a "Guitar Hero" style video game, and an after-party at the MI-6 nightclub in Hollywood that reported drew as many as 200 attendees.

"ASFX was founded about three years ago by activist Justin Ross," Barnett told AVN, "and the whole concept was, condom use is going down, STDs are going up, unplanned pregnancies are going up, so we wanted to do something different and fun and interesting to encourage people to have safe sex, and the Screaming O has got a really cool product, the Screaming O Vibrating Condom Pack. So we thought, what if we can launch a campaign, non-profit, where we're encouraging people to have safe sex in a fun way? Our motto is, 'Play safe, safe sex.' And the whole concept is, safe sex doesn't have to be boring sex, it doesn't have to be worse than unprotected sex. Safe sex can be better than unsafe sex. Also on hand for the event was Kenny Santucci, a member of the veterans team on the MTV program "Gauntlet 3," and who, with a partner, was the second runner-up in "Real World/Road Rules Challenge: Fresh Meat," a reality TV show filmed in Australia.

"I'm going to start promoting it on Twitter, for the people who follow me on Twitter, @KennySantucci," Santucci said, "and I'm going to get the word out there, get the word out to the kids. I do a lot fo public appearances, so I've got a little bit of a decent following, and I'm going to get the word out there and show the kids some new toys. There's a couple of really cool toys here, and I think everybody should try them out. I've been working on these things for a while, and my girlfriend doesn't have any complaints."

ASFX will be videotaping the events and using the footage for a series of public service announcements on its website and any other venue that will carry them—and Barnett noted that he's been pleasantly surprised at how well ASFX has been received by college students.

"It's been fantastic," Barnett said. "At first, we thought the concept might be a little too edgy, but what we found is, everything's so edgy as it is these days that people love it, and it gives college students and people in general the chance to enjoy safe sex and try something different."

Claims all performers are damaged by AIM testing procedures and disclosure

LOS ANGELES—The AIDS Healthcare Foundation (AHF) announced today that it had enlisted two former adult performers, Desi and Elli Foxx, to sue the Adult Industry Medical Healthcare Foundation (AIM) for alleged violations of medical privacy laws. The lawsuit is expected to be filed today in Los Angeles County Superior Court.

Although an AHF press release claims that the organization has "separately been championing safety reforms in the adult film industry," in fact, the actresses' primary attorney is Brian Chase, who is also AHF's assistant general counsel and is representing the actresses without charge ("pro bono"), clearly as part of AHF's long-running campaign to force the adult industry to adopt a "condom/dental dam/goggles only" policy for sex scenes.

At a news conference held this morning, AHF president Michael Weinstein claimed, among other falsehoods, that AIM tests only for HIV, chlamydia and gonorrhea, and does not test for syphilis, human papilloma virus (HPV), herpes or hepatitis—in fact, AIM tests for syphilis every six months, since it is a less-common STD, and tests for herpes, HPV and hepatitis at its clients’ request; plus, it provides anti-hepatitis and HPV vaccinations for all performers entering the industry.

Although AIM is a testing facility which employs a physician to oversee its activities, Weinstein claimed that AIM itself should be held to the Hippocratic Oath taken by physicians to "First, do no harm," implying that testing performers to make sure that they are free from sexually transmitted diseases is somehow harming them.

According to the AHF press release, "AIM violates the privacy rights of performers in the adult film industry by allowing the producers of adult films online access to workers' health care information without the individual consents and releases required by federal and California law. AIM knowingly and intentionally provides this private information to producers of adult films in order to facilitate the production of adult films." On the contrary, however, performers who test at AIM sign an agreement allowing AIM to make their test results available only to adult producers who may wish to hire the performers for adult movies and web content; the information is not made available to the general public or anyone outside the adult acting/producing community.

The lawsuit further claims, "AIM further jeopardizes the health and well-being of performers in the adult film industry by discouraging the use of condoms and other safer-sex practices known to prevent and dramatically reduce the spread of STDs." Although AHF personnel have been to the AIM facilities several times—most recently during a protest march outside AIM's Van Nuys offices about two months ago— apparently they missed the large bowl of condoms in the lobby of AIM's facility, which anyone who visits is free to take as many as they like. AIM has also produced videos, "Porn 101" and "Porn 102," featuring veteran performers Nina Hartley (who's also a trained nurse), Brooke Hunter and Dr. Sharon Mitchell, which is available on its website, which details safe-sex practices which performers are urged to engage in when performing in adult content, and in their personal lives as well.

The lawsuit describes both AIM's system of disclosure only to the adult producer community, and its testing authorization document, which also indemnifies AIM from damages related to that disclosure, as "an unfair, fraudulent and deceptive trade practice" under California law, even though those wishing to perform in adult content voluntarily sign the authorization before testing in order to help prevent sexually transmitted diseases (STDs) in the industry. The AIM regimen has prevented all HIV transmission within the hetero adult community for the past six years, and kept transmission of STDs a very low levels.

AHF is seeking to have its lawsuit certified for "class action" status, and if that were accomplished, it would mean that all adult performers would be considered plaintiffs, whether they approved of the lawsuit or not.

That Desi and Elli Foxx—who performed both separately and as a mother/daughter team in a total of less than 50 adult productions beginning in 2007 until they both quit the industry in 2009—were enlisted as the plaintiffs in this lawsuit is hardly surprising. Desi, under her real name, Diana Grandmason, runs a website, porninthevalley.com, wherein she claims that, "There are women and children who are trafficked into Porn Valley every year," and that, "Degradation and abuse of women in porn is increasing sexual violence all across America." Neither claim is true, and recently have been debunked in, among other studies, "The Porn Report," by Prof. Alan McKee, Dr. Katherine Albury and Prof. Catharine Lumby of the University of Melbourne in Australia.

Moreover, Desi Foxx has long been connected to Shelley Lubben's Pink Cross Foundation, and wrote an extensive "confession" on the Pink Cross site, since taken down, about her personal experiences before she and her daughter got into porn.

In answer to a question at the press conference, Desi noted that it wasn't because of having contracted any STD that the pair left the industry.

The AHF press release claims that AIM's "actions and ongoing business practices repeatedly place thousands of people like [the Foxxes] at risk of disease and death," ignoring the fact that AHF's own HIV testing procedures use HIV antibody testing, which the adult industry abandoned more than a decade ago as too unreliable, since a person could be HIV-positive for as long as six months and still "pass" the test.

Though one of the AHF officials—either Weinstein or Chase; the speaker was not identified—claimed at the press conference that it was not trying to drive the adult industry out of business, the official made it clear that, between AHF's pushing for investigations of AIM in California, Florida and nationally through the federal Department of Health and Human Services, and through the various laws restricting adult filming in states other than California, Florida and New Hampshire, AHF doesn't think the industry has anywhere else to go besides California, so if its attempts to have AIM shut down are successful, the practical effect of AHF's campaign will be to destroy (or at least severely cripple) the American adult entertainment industry.

The Free Speech Coalition's Anti-Piracy Action Program (APAP) has thus far documented 287 million views of infringed content on tube sites

CANOGA PARK, Calif.—Since its launch in April, Free Speech Coalition’s Anti-Piracy Action Program (APAP) has documented nearly 287 million views on 1,700 clips identified with APAP’s best-of-breed spidering software. Overall, 18 adult production companies participating in APAP have fingerprinted more than 5,000 titles with the software to track content and gather data from infringing tube sites.

“What an eye opener,” said Adam & Eve President Bob Christian. “To see from a small test that over 13 million illegal, unauthorized viewings of just seven of our expensive, high-quality movies have occurred is staggering to us. This is important work going on!”

APAP’s day-to-day operations are overseen by attorney Gill Sperlein, of Sperlein Law. Alongside his work with APAP, Sperlein also is in-house counsel for adult production company Titan Media and is a leading adult industry attorney in copyright infringement litigation. Titan Media recently was awarded $1.35 million by a U.S. District court, in a suit against tube site operators Antelope Media LLC.

Since the program has been in full operation, more than 1,700 DMCA notices have been sent to infringing sites on behalf of APAP participants, Sperlein said.

In addition to tracking content, delivering data reports to participants, and issuing DMCA notices to infringing sites, APAP also offers producers an option to monetize their content on tube sites. APAP organizers are negotiating with tube site operators to take down illegal content and replace it with legal clips that lead viewers to a retail option where they can purchase content, with technology similar to that being used on YouTube and other legitimate tube sites. 

“I’m really excited to be working on this project, because it is going to bring about a fundamental shift,” Sperlein said.  “APAP provides a model for tube sites to go legitimate and for content owners to start getting their fair share.”

The program also offers free pre-litigation counseling to assist producers that are considering legal action against infringers. APAP organizers also can provide options for producers to form litigation groups, to file suit against infringers. Data reports compiled by APAP can be used as evidence of infringement, in the event of a lawsuit.

Participants also are given a FSC-branded APAP logo to use on DVD packaging or display on their websites. The logo indicates to infringers that the participant’s content has been fingerprinted for tracking through the program.

APAP is available to FSC member content producers for a set-up fee of $450, and low monthly charges based on the amount of content being tracked.
