Former Adult Biller Arrested for Abetting Illegal Online Gambling

NEW YORK—A 27 year old Australian man who made a fortune worth a reported $80 million is now facing 75 years in jail, charged by federal authorities with violating the Unlawful Internet Gambling Enforcement Act (UIGEA), which makes it a crime for anyone to assist in financial transactions associated with “unlawful internet gambling.”

Daniel Tzvetkoff, 27, is the first person to be charged under UIGEA. In an indictment unsealed April 16 in Manhattan, the U.S. Attorney for the Southern District of New York alleged that Tzvetkoff and his partners unlawfully laundered more than half a billion dollars in internet gambling proceeds between early 2008 and March 2009, when Tzvetkoff stopped billing for internet gambling transactions.

Tzvetkoff was arrested in Las Vegas two weeks ago and was seeking to be released on bail. Despite earlier reports that he was released Wednesday morning, a New York district court actually reversed a decision by a Las Vegas magistrate to grant bail, citing prosecutors’ belief that he was a serious flight risk. Instead, he will be transported from Vegas to New York, where he will remain incarcerated, according to Gambling 911.

The indictment against Tzvetkoff lays out a sophisticated scheme in which the co-conspirators “created dozens of shell companies with names unrelated to gambling—complete with phone web sites that made the companies seem legitimate—and represented to banks that the ACH (Automatic Clearing House) transactions were on behalf of those companies.”

The indictment also alleges that Tzvetkoff stopped transacting for gambling transactions “after leading gambling websites accused him of stealing approximately $100 million from them. Tzvetkoff has been charged with four counts, including bank fraud, money laundering and conspiracy to operate and finance an illegal gambling business and to process electronic funds transfers in violation of the UIGEA. The FBO and ICE were both involved in the investigation.

Tzvetkoff ran adult processor Merchant Solutions, which was in business as late as 2007, when it was nominated for an XBIZ award. That same year, he founded online payment processor Intabill, which still has an online presence. Merchant Solutions is no longer in business.

According to the Herald Sun, “Tzvetkoff's world came crashing down last year when his main Brisbane company, BT Projects Pty Ltd, was placed in liquidation with debts estimated at nearly $80 million. His Intabill company, a subsidiary of BT Projects, sacked its workforce, the head office disappeared and Mr Tzvetkoff's exotic cars, including his prized Lamborghini with the number plate "BALLER", were sold.”

Declaring bankruptcy, his prized yacht also was sold as was his “Zuri nightclub in Fortitude Valley and his palatial Hedges Ave property on the Gold Coast, bought from Tony Smith for $29 million. He was also facing a $100 million lawsuit filed by his former business partner, lawyer Sam Sciacca, claiming he ‘diverted funds payable to the company to cover personal expenses.” He also reportedly faces a $43 million lawsuit by a former customer.

The paper reports that despite those setbacks, Tzvetkoff continued to operate an offshore billing and consulting group, and this month made the ultimately fatal decision to travel to Las Vegas to attend an internet billing conference, “where it is believed he came to the attention of several large US online internet players to whom he owed money and they reported him to the authorities.” He was arrested April 16.

Not everyone is convinced that Tzvetkoff deserves to be facing life in prison, however. According to Jacob Sullum from Reason.com, “When you add together all the maximum sentences—five years for the gambling conspiracy, 20 years for each money laundering count, and 30 years for bank fraud—you see that Tzvetkoff faces up to 75 years in prison for the crime of helping Americans play poker.

“All this,” he continues, “is based on a New York State offense, ‘promoting gambling in the second degree,’ that is classified as a misdemeanor and that arguably does not cover poker.”

Ultimately, concludes Sullum, “The government can scare companies such as PayPal and Neteller out of the market and it can prosecute successors such as Tzvetkoff if they're foolish enough to visit the U.S. But because poker prohibitionists cannot impose their will on the entire world, there will always be plenty of alternatives for Americans who dare to defy their government's ridiculous recreational restrictions.”

New Visa Rule Takes Aim at Third-Party Merchant Cross Sales

SAN FRANCISCO—In January, Visa sent out a policy statement to its merchants saying it would no longer tolerate what it calls deceptive marketing and unfair business practices, including certain types of cross sales.

Tuesday, Visa announced steps intended to ensure that merchant practices abide by the previous warning. Specifically, the new rule prohibits “web merchants from providing cardholder information to other companies without the consumer's knowledge or active consent.” The move is intended to curb the worst practices associated with what Visa refers to as “data pass” and the online porn industry refers to as “cross sales.” The new rule, though crafted to target cross sales, does not appear to be directed at IPSPs (Internet Payment Service Providers), otherwise known as third-party processors, which are widely used by adult webmasters.  

“The misleading practice, called ‘data pass,’ usually involves a consumer shopping at a familiar retailer,” said Visa, in a press release. “At checkout, the consumer receives an offer for a discount or reward and does not realize it is from a different merchant and comes with unexpected monthly membership fees or recurring charges. Such deceptive marketing can result in high levels of consumer disputes and degrades the efficiency, reliability and security of the payment system. According to a 2009 U.S. Senate Commerce Committee staff report, 35 million consumers have paid $1.4 billion for ‘data pass’ marketing offers.”

The “data pass” practice is not unknown to Congress; last year, the U.S. Senate Committee on Commerce, Science and Transportation investigated the issue and merchants who use it. According to its chairman, Senator John D. (Jay) Rockefeller IV, the committee’s investigation “showed that this aggressive marketing practice enabled unscrupulous e-commerce companies to scam millions of American consumers out of more than a billion dollars.”

A lot of online porners also utilize cross sales, which became extremely popular several years ago as direct sign-ups began to decline. The practice of offering “upsells” or ancillary “benefits” or “options” is certainly not new to all forms of merchant products both adult and mainstream, but online the practice, if used fraudulently—which basically means taking measures to conceal the added charges—can reap substantial returns.

When cross sales are pre-checked, the consumer will have to realize they exist and then take measures to opt-out at some point (if they so desire) or get hit with recurring charges of up to $100 a month or more. Though a life saver for some programs, one potential downside to the practice is that it alienates consumers, many of whom have been burned in the past by online scams. The flip side of that argument is that, if used properly—which means making sure the “offers” are clearly visible and follow-up emails are sent—the practice is an entirely legitimate tactic to increase sales.

For the moment, Visa only appears interested in targeting the way in which the practice is being used by merchants with different merchant accounts. For those who have their own merchant accounts, including IPSPs, the ability to cross sell within the same account still seems to be allowed.

“Visa's rules already prohibit merchants from sharing a cardholder's account number and other Visa transaction information with any entity that is not directly involved in completing the transaction, preventing fraud, or as required by law,” the Visa announcement said. “To address the data pass practice, merchants will now have to prompt consumers to re-enter their card information to accept a subsequent offer from a third-party merchant. This provides a clear signal to cardholders that a second purchase is being initiated and protects them from questionable marketing practices.”

According to Epoch’s Director of Communication, Rand Pate, the IPSP will not have to make any changes to its billing practices.

“Epoch is already compliant with the rules,” he told AVN.com. “We do not pass card data to other third parties so our policies are not affected. The stand that VISA is taking primarily affects companies with their own merchant accounts that pass card data to other companies to make cross sells.

AVN.com also contacted leading affiliate program TopBucks, which utilizes Epoch-managed cross sales on some of its sites.

“We have always thought of being heavily dependent on cross sale revenue as a short-lived business strategy, given the obvious abuse of cross sales by many merchants, both within the adult industry and in mainstream,” the company told AVN.com. “This is one reason why TopBucks steered clear of relying too much on cross sale revenue, and focused our efforts on building direct sales to our sites. This change will have no real impact for us, but we anticipate that it will roll into a much larger issue than just losing incoming cross sales for some companies, as it is bound to create chargeback ratio problems for companies that are not able to cover their loss of incoming cross sales with their current volume of direct sales.”

The program also concurred with Epoch’s assessment of the limitations of the new rule.

“We’ll definitely be evaluating the new policy in greater detail to ensure we’re in compliance,” it said. “At first glance, we do interpret the rule to mean that cross sales within the same single merchant are allowed, which would likely mean that cross sells among third-party IPSP clients are allowed, as well.”

AVN.com has requested legal input as to the actual meaning and limitations of the new rule, and is awaiting a reply.

NEW YORK CITY—Joe Sarno—aka Irving Weiss aka Monica Fitta aka Eric Andersson aka Lester Jordan aka dozens of others—died on Monday of undisclosed causes, leaving a legacy of adult and sexy mainstream films nearly unmatched in the history of adult cinema.

According to the Internet Movie Database, Sarno directed 105 films during a career that lasted over 40 years, often employing adult performers in his more mainstream projects. For example, Sarno's last work, Suburban Secrets (2004), about a famous nude model who returns to her home town to find that her ex-boyfriend is having an affair with her aunt, starred an adult actress in a major role. Sarno has been described by film historian Michael Bowen as "the Ingmar Bergman of sex films."

"Joe was a well-respected mainstream filmmaker, having made close to a hundred feature films, mainly in Sweden, both sexploitation and horror," noted actor/director Gino Colbert. "His best work was in the psychological drama genre. One of his films, Inga, ran for over a year on 42nd Street and was considered groundbreaking at the time. Joe worked up until a few years ago, making the sexploitation picture Suburban Secrets, which starred Tina Tyler. Martin Scorsese saw it at a film festival and complimented Tyler's performance. And Joe had another script in development. He was a regular at film festivals, being honored for his amazing body of work. Last year, he was honored at a film festival in London and one in Italy for his work. He also lectured in film schools around the country."

But while most of Sarno's adult productions were directed under pseudonyms, or credited to others, they include movies that would show up on almost anyone's list of the best adult films of all times.

"For years, he was the in-house director for [Howard] Farber and [Arthur] Morowitz in NYC," Colbert explained. "He was responsible for creating the 'Inside' movie series—All About Gloria Leonard, Inside Seka, Deep Inside Annie Sprinkle and many more—which became huge box office successes and are now classics. I believe he directed their first porn release, which put them on the map as distributors of their label, Video-X-Pix. Together, we made over a hundred features in NYC, he as director and me as his line producer. He is responsible for me being in this business. I met Joe in 1979 when he was casting Inside Seka and he hired me for an orgy scene which was shot at Plato's Retreat in the Ansonia Hotel. He was extremely generous with training directors and enjoyed sharing his amazing wealth of knowledge."

"I remember there always being a very good relationship between Joe and my father, a very wonderful working relationship, and they've shared many meals over the past years," added Steven Morowitz, Arthur's son and currently the head of production for Video-X-Pix. "They had lunch a few months back, but Joe was getting older and it was harder for him to get around. Joe's son, Billy, has been working for my father for almost 30 years now. About a month ago, I was told that Joe was in the hospital. He was in and out for maybe the last month,  and he was potentially being moved to a hospice, but I think [his death] may just have been from old age."

"Mostly when it comes to the sexploitation world, Joe was something of a hero," Morowitz added. "He's also been very proud, especially over the last 10 or 15 years, with all the reissuing of films from that era and the film festivals; there's been a lot of demand for his movies. For my old man, he did a film, The Bed and How To Make It, which we've now transferred from 35mm and will be releasing soon, and there were others that were even more popular, so those are the films he's been known by. We've got a film coming out shortly called Nude in Charcoal (1961), which was the first film Joe ever made. It's never been out on disk or tape. We have it on 35mm negative, and we transferred it; it's a wonderful little piece of sexploitation history."

The Bed and How To Make It—a sort of parody of a then-popular mainstream film, The Knack and How To Get It—featured Sarno's wife, Peggy Steffans, in one of the lead roles. Peggy was a popular actress on the sexploitation circuit in the mid-'60s, and appeared in at least 15 of Sarno's own productions.

"Joe Sarno was a king among porn kings; I'm very sorry to hear of his passing," wrote Annie Sprinkle in an email earlier today. "Fortunately I saw him last summer for a little '70s porn folk reunion. Joe was a lovely, lovely, darling person that really cared about his films and the people that worked for and with him. He is the first person that really tried to coach me how to act. He said, 'Don't forget to breathe.'  That was a great tip which I still use today."

"I did about 8 or 10 films directed by Joe," she continued. "He was also the first of the directors that I worked with that really took time to go for the woman's orgasm in a sex scene. What a concept! Joe may be gone in the flesh, but will live on in my heart, for sure. He was a real sweetie and I will always remember him so fondly. He taught me a lot and inspired me."

Colbert echoed and expanded on some of Sprinkle's remembrances of Sarno.

"Joe had a very distinct style of shooting hardcore," Colbert said. "He focused on the female orgasm—nothing in a scene mattered more—and he never used music over a scene. He believed in capturing the real sight and sound of real sex. And his movies were technically perfect. He was an amazing filmmaker who left his mark on the industry from his first adult feature."

"He really does have a legion of fans," Morowitz agreed. "I know from talking to Joe, he didn't want to be known as a porn director—that's part of the reason he used so many pseudonyms—and although there's been a lot of effort on the part of certain scholars to kind of negate the fact that Joe was a pornographer, I know he was a real filmmaker, but I'm one of those people who celebrates everything in his collection."

"Joe was a wonderful guy," he continued. "When I first knew of Joe, it had nothing to do with filmmaking. I was just a kid, but I remember him as being amazingly jovial—a big man, a husky guy. I remember one thing: As a kid, I'd tag along to these Chinese food dinners that would include Joe, my old man, Howard Farber, the whole Video-X-Pix gang, and I remember Joe had this little trick: He used to eat these hot Szechuan peppers, and I couldn't believe how he did it; he used to turn beet red. For some reason, there was this ongoing gag where Joe could eat these Szechuan peppers, he'd turn red and his voice would go all hoarse. It was funny."

"For whatever the reason, there was definitely a special bond between Joe and my father, and I think my father was one of the main reasons why Joe became successful: He got Joe's films exposed."

ASACP Releases PSA on How To Label Your Website with RTA

LOS ANGELES—The Association of Sites Advocating Child Protection has released a public service announcement explaining how webmasters can label with the Restricted To Adults – RTA Website Label.

The video is currently available for viewing on the ASACP YouTube Channel.

RTA is an initiative in the adult entertainment industry to protect children from viewing content that is age-restricted. It was developed by ASACP to provide an easy-to-use and internationally recognized label that designates content for adults only. The RTA label is a unique string of “meta data” which can easily be inserted into the computer code of any website. Parental filtering software recognizes the tag and prevents children from viewing adult content. The RTA label is free and universally available.

“No one wants a mandatory, complicated, and potentially expensive website labeling system. This is why ASACP and its technology and forensic research director, Tim Henning, worked with the adult industry to create the Restricted To Adults – RTA Website Label,” stated ASACP CEO Joan Irvine. “I encourage all adult entertainment webmasters who have not yet labeled with RTA to view the PSA. Henning developed the RTA system and continues to make it easier for companies to label their sites with instructions for page-, site- or server-level labeling. Last year, ASACP launched the RTA Verified service which confirms that websites have been properly labeled with RTA. While RTA is free, RTA Verified costs a small fee. RTA Verified subscribers are also issued a special button and link to a verification page that lets you and your visitors know that your websites are properly labeled with the Restricted to Adults website labeling system.

LOS ANGELES—Former Sony Pictures Senior VP for Strategy and Operations, Christoph Pachler, has taken over as the new chief financial office at Playboy Enterprises, the company announced.

The hire is part of Playboy’s larger aim to transform itself into a “brand management company,” Playboy CEO Scott Flanders said in a statement.

At Sony, Pachler managed the financial aspects of Sony TV’s expansion into international markets and handled a number of content and production deals as well as restructuring arrangements.

“We will draw on his wide range of experiences, and his responsibilities will extend well beyond those of the traditional CFO,” Flanders said. Pachler’s CFO position will be at the executive VP level. He will be based in the Los Angeles office.

In previous statements Flanders has suggested that the company will rely increasingly on outsourcing and licensing of its brands. The earnings for the first quarter of 2010 are set to be announced on May 6. SmarTrend reports that analysts expect the company to report a loss of $57 million for the quarter.

The CFO position has been open since the beginning of this year when Linda Havard left the post. Robert Campbell served as interim CFO since then.

LONDON—If most men are like men in the United Kingdom—and why wouldn’t they be—then a full 30 percent have an issue with premature ejaculation, arguably as serious a dysfunction for men (and women) as impotence. But a new pill to deal with the problem that is currently in use in other countries will soon be available to British men, through private online prescriptions only.

The active ingredients in Prilogy modify levels of Serotonin in the brain, reportedly giving men the ability to last three times longer than usual. According to Nitin Makadia, head of male sexual health at one of the U.K.'s leading pharmacies, it could provide revolutionary relief similar to its impotence-preventing cousin.

“Prilogy has the potential to do as much for men's sexual health as Viagra,” he said. "It will give sufferers a chance to improve the quality of their relationships and their general well-being.”

The drug is costly, though, at about $116 for three 30mg tablets, and is available only for men between the ages of 18-64. It is not available in the United States yet.

According to the Sun, Prilogy will not be added to other methods traditionally used by men to hold off the usually sex-ending ejaculation such as “stop-start and squeeze techniques, condom use to decrease sensitivity and counseling. All have been shown to have limited success.”

But have they tried baseball? We are told that concentrating hard on a suicide squeeze play has been known to work wonders. It is not known whether a similar fixation on, say, cricket, or some of Manchester United’s more dramatic goals, would also do the trick.

Our one concern with Prilogy is the “three times” assessment for prolongation. That sounds nice as a theoretical unless you’re the chap who tends to come within, say, thirty seconds. Ratcheting up the action to a full two minutes (we're being generous) might be cause for a victory lap to some, but our concern is that for others—particularly those on the other end of the equation—taking an expensive pill for so few additional seconds could be seen as throwing good money after bad.

Our advice: try cricket first and then pop the pill.

LOS ANGELES—Adult performer Nick Manning recently landed his first lead role in a non-adult movie, starring as a sleazy strip-club owner in the indie film Cherry Bomb.

“I’ve been in a lot of mainstream flicks, but this is the first time I was actually leading man in the movie,” said Manning, who was on location shooting in Austin, Texas for most of March.

Manning said the R-rated horror film is like an updated version of I Spit on Your Grave, the controversial rape and revenge movie released by Cinemagic Pictures in 1980. In Cherry Bomb, the lead character Cherry (Julin Jean) gets gang-raped in the VIP room of a club owned by Ian Benedict (Manning), and then returns to gorily kill all the guys that committed the crime.

“What was interesting was kind of how it all came about. I was in Crank 2 last year and [the Cherry Bomb producers] are big fans and they saw me and told me they were producing an independent film in Austin,” Manning said. “So they called me up and cast me for the lead role. I’m the creep, one of the guys that gang rapes her. By the time I rape her she was knocked out.”

Manning says that his signature porno line “dropping loads” finds its way into the movie when his character gets blown away in dramatic fashion. Cherry says, “I’m going to drop a load on this motherfucker” before Benedict’s demise.

“Even in mainstream we truly are pop culture,” Manning reasoned. “Every movie I do they find a way to get ‘dropping loads’ into it.”

Manning said he came away impressed with the filmmakers, including director Kyle Day and executive producer Jason Latimer.

“These guys have never done a full-length feature before,” Manning said. “We finished on time and it was really well done. The guy knew his shit, even the sound guy was good.”

Manning said at press time the movie was being shopped around for distribution.

“It was fun, I missed having sex for that long, but it was a great experience,” said the AVN Award-winner for Best Male Newcomer in 2003 who has become one of the top performers in adult. “It’s very anticlimactic after you’ve done your dialogue you don’t get rewarded, you just go home. You’re like, ‘there’s something missing here.’”

    Manning said he got Vivid Girl A.J. Bailey a cameo appearance as a stripper in Cherry Bomb. He'll be seen later this year as the Dark Knight character in Bluebird Films’ big-budget, action feature Batfucks.

    “My only real passion is football on Sunday’s with Vinnie Jones,” says Hay, the owner of LA Direct Models who hails from North London, where football (American soccer) is king. “Vinnie runs a football team called the Hollywood All-Stars. He’s an ex-English Premier League player and now he’s a very successful actor. I play on the team and actually so does Danny Mountain and Kieran Lee.” 

    Hay jokes that he plays defense “because I’m too slow to play anywhere else now.”

    “The Santa Monica adult men’s league is not age restricted so there’s quite a few 20-year-olds in that,” he says, adding that Jones’ high profile often attracts some notable players. “… If there’s an English celebrity in town they usually end up on our football team. … That and the UFC are my only pleasure activities.”

    It’s a work ethic that has paid dividends for Hay and his talent agency, which this month is celebrating its 10-year anniversary. LA Direct Models will toast the occasion on Monday night with a party at Les Deux in Hollywood that begins with red-carpet arrivals at 9:30 p.m.

    Hay ran Direct Models for a year in his native England before quietly launching in the U.S. in 2001 with the help of his former significant other Hannah Harper. He says he never had a business plan going into it.

     “I just wanted to do something that I would find equally as fun and interesting as working for major rock n’ roll artists that I had done for nearly 20 years before I started Direct Models, and I found it in the adult industry,” says Hay, a former stage manager in London for touring acts such as the Rolling Stones. “So I just took my upbringing and no better than a high school education, and just took what I knew from that and what I learned in the music business and started an agency catering to the adult industry.”

    And even Hay admits he never thought LA Direct would get this big.

    “How could one have imagined,” he says. “Literally, the American version of Direct Models started in a one-bedroom apartment just down the street there on the corner of Vineland and Ventura [Boulevard]. Before we left that one-bedroom apartment we had four employees in a semi-circle of desks and that took up the entire front lounge before that apartment building very kindly told us, very politely said that our welcome had run out. And they had been gracious in extending us as much time as reasonably could have been expected because they knew that we were running a business out of our apartment.”

    Now Hay & Co. operate what has become one of the largest and most prolific agencies in the history of adult entertainment right in the heart of Universal City, just down the hallway from Vivid Entertainment Group. At any given time LA Direct Models represents around 120 female performers and about 30 guys. The agency more recently has also begun representing production professionals such as makeup artists, videographers, directors, a still photographer and an editor. Open seven days a week, LA Direct books an average of 30 to 40 jobs per day.

    “In terms of the talent that we represent, our greatest achievement has been long-term career success, longevity in a girl’s career as well as helping them achieve success at the highest level,” Hay says. “I think in terms of the company, I think we’ve done a lot to change the face of the agency business and its place in the industry, and talent representation as a whole. We have many competitors now and many of those competitors sort of follow in our footsteps or conduct their business in very similar ways to us.”

    He adds, “We often get complimented by our clients, by our producer clients from their experience in working with us, which is nice.

    “Being an agent in the adult business you’re really providing a service to both sides. I mean our clients of course are the talent that we represent. And by the very nature of our business we have some obligations and responsibilities to live up to the obligations of the studios and producers that hire our talent. And living up to those normal business relationships, responsibilities and obligations is what set us apart I think.”

    Hay works round the clock on LA Direct business, and so does his staff which has long been anchored by Francine Amidor, whose job title is “accounting and finance” but whose role within the company can’t be understated.

    “I’m known as The Oracle, the all-wise, all-knowing person here,” Amidor says. “I’m part bookkeeper, part babysitter, part guru.”

    The native of North London says she came to the U.S. to “to seek fame and fortune and mingle with the rich and famous.”

    “The first eight years went fine because I worked in a studio for rock n’ roll bands,” Amidor says. “That was eight years and then I worked for somebody else for about seven years, and I’ve been with Derek since. How did I meet Derek? I was working for Jerry T. who used to shoot for Teravision and Hustler. Jerry T. used to have a printing shop and when he closed shop he decided to go back into pornography because he left for 20 years. And he said ‘if you ever want a job come on set, come be a [production assistant],’ so that’s how I got onto a porn set is through Jerry T.”

    Amidor continues, “And then I met Hannah Harper who was dating Derek Hay and Derek Hay said to me, ‘Oh, interesting talking to you. Hannah and I are thinking of starting a small agency. I might have a part-time position for you.’ Part-time lasted about three minutes and I do 63 hours a week now.”

    She vividly recalls the agency’s humble beginnings.

    “We had six girls, so I did everything from collecting money to driving girls to shoots to housekeeping services. We had one apartment and then we had two apartments. …And then it just escalated.”

    Depending on the day, Amidor may find herself doing just as much life coaching as accounting.

    “These girls need some goddamn advice, not that they take it but I can’t see someone throwing their life down the toilet. I don’t mean to do porn, I mean the money that they earn,” Amidor says. “They’re too young to earn the amount of money they earn and then they just piss it away. They haven’t got 120 dollars for a test but they’ve got a $4,000 handbag.”

    Hay says Amidor was his first-ever full-time hire nine years ago.

    “She’s still here as everybody knows, Thank God,” Hay says, “so that’s remarkable, obviously.”

    Hay employs two industry veterans as his top agents, Robert Moran and AVN Hall of Fame director Bud Lee, who recently hit the two-year mark with LA Direct. A native of Indianapolis, Lee first began coming to LA to work in adult in 1981. With 29 years of experience, he has seen generations of talent come and go and watched the agency landscape evolve.

    “When you’re a director you’re very company-and project-oriented and when you’re an agent you’re very talent-oriented,” says Lee, who still occasionally directs. “Sometimes I feel like I’m wearing a different hat. Producers are extremely important to us but at the same time we’re hired by the talent.

    “I think that what has happened with the talent agencies is a good thing. I think it helps keep down unscrupulous producers and with LATATA [the Licensed Adult Talent Agency Trade Association], that’s a perfect example of being able to merge those resources together.”

    Lee says one of LATATA’s positive impacts has been how it protects the girls.

    “There’s too many talent that I’ve seen over my last 30 years that have gotten chewed up and spit out by producers. I like the fact that it’s brought up the level of professionalism in our business,” he says. “I think no offense against any of the older agents who were here 20 years ago, but they didn’t operate on the same level of professionalism that it is now. And I think LA Direct Models and Derek have set that bar as far as professionalism goes. I think the more professional we look as an entertainment entity the more we are palatable to the public.”

    The Dallas native Moran says the keys to LA Direct Models’ success are “reliability and accountability.”

    “We say our talent is going to be here and going to be tested and that is something we follow through with,” says the 31-year-old agent, who has been with LA Direct since 2005.

    Moran got his start in adult as a production assistant at Jill Kelly Productions and Sin City. Then he worked as a production manager at Metro as well as Vertigo, American Harcore, Defiance and Torrid, the last four of which have since closed.

    “I was doing the five companies all at once, like two days I’d be on set with one and the next two days I’d be on set with another. I did all that and talked to Derek on the phone all the time,” Moran says.

    Then after reading about an opening at LA Direct one day he called Hay, who brought him in and started him out at the front desk.

    “So I worked at the front desk I want to say for about six weeks and then I got promoted to agent and I’ve been here ever since,” says Moran, who like Amidor works roughly 63 hours a week, give or take. “It’s cool, fast-paced I would say.”

    Moran says that being a good agent is not about trying to bang the girls.

    “I think the outsider, people who aren’t agents just look at the girls and think they’re really hot, and they just want to bang ‘em, but I look at it as, what are we going to have to do to get the girl to set today?”

    Moran continues, “I don’t look at the girls as someone I want to have sex with. I look at them like what do I have to do to get this shoot done this day and take care of the directors that book with us…”

    The LA Direct owner points to a couple other team members who have worked for his company for many years. Tracy Araki, who does accounting and human resources, has been at Direct for over five years, while Veronica has been a mainstay on the front desk staff over six years.

    Hay, also known throughout his career as performer Ben English, recently stopped doing scenes after appearing in close to 800 movies. He won a pair of AVN Awards, including Best Male Newcomer (2004) and Best Supporting Actor (2009) along the way, but says that the agency “was always my focus.”

    “This was always my priority,” Hay says. “I’m 45 and I just wanted to go out, to end performing gracefully, and at the same time we’ve been diversifying into some other areas and I wanted those things to have my full attention.”

    Indeed, LA Direct has been steadily expanding into other areas, especially web-based endeavors.

    “We have a vibrant division of the company with producing solo girl websites,” Hay says. “We have I think 10 sites approximately active now with many of our bigger name girls. Many of the sites we have are through Premium Cash (Alexis Texas, Lexi Belle).  We also work with Blazing Bucks (Hanna Hilton) and Brand Danger (Kagney Linn Karter).”

    Hay says Belle’s website has taken off.

    “Lexi Belle is notable. We’ve had Lexi for three or four years. She’s pretty well-known as the ultimate teen girl. She’s the teen queen if you like. We’re very pleased and so is she that Lexi’s website does extremely well.”

    He continues, “We also provide editing services now for movies. We do editing for Immoral Productions, Sweet Sinner, Harmony Films...That’s an expansion of our business. About a year ago we started representing production stuff…And there are several companies that we do webcam through. That’s an important part of it as well.”

    On May 4, LA Direct will bring back its Rouge Night, which showcases its models in a feature-dance setting as most of them make their dance debuts at the Rouge Gentlemen’s Club in Van Nuys. Their newest one-night only event is dubbed “Stripped” with rising stars Breanne Benson, Amy Brooke, McKenzee Miles, Sadie West and Angel Vain all taking the stage.

    “Rouge Night is coming back once a quarter now,” says Hay, whose office also includes the Southern California headquarters of the well-known feature dance agency, The Lee Network, which launched an LA branch a year ago.

    Hay tells AVN that LA Direct is comfortable with the number of models it represents and has no plans for any significant increases.

    “The goal was always to diversify and expand the amount of work we can offer those models, not to increase the number of models,” he says.

    However, building the Direct Models brand in other locales is something that interests Hay.

    “You’ve always got to have goals. For some reason I have a hankering to do something in Australia. I think it’s really an untapped market,” he says.

    Several of LA Direct’s guys are continuing on an upward trajectory, such as 2009 AVN Best Newcomer Anthony Rosano, Danny Mountain and Bill Bailey, who was booked more than 20 times in March.  

    Meanwhile, Hay represents numerous AVN Award-winning girls and exclusive contract stars.

    “The thing that continually inspires me to work as hard as I have in the last 10 years and continue to do so is to see the real career success, such as Tori Black of course who was on the cover of your last edition,” Hay says, referring to the 2010 AVN Female Performer of the Year who won multiple AVN Awards in January.  

    Kagney Linn Karter, a Zero Tolerance contract girl, is one of LA Direct’s recent big achievers, winning the 2010 AVN Best New Starlet award in January on the heels of numerous magazine and box covers. The Missouri native says her agency played a “huge role” in her career development.

    “Thank God for Derek Hay, I said that on my speech for AVN, one of the, if not the most powerful agency ever in the adult industry. It took a lot of dedication and work to build something like that,” Karter says.

    “If I wouldn’t have had all the elements that Derek Hay and LA Direct Models bring as a team, I would be here, but where? They have played a major, major role. I think that now—and I say this in the nicest, kindest, most humble way—now I would like to think that because of girls like Tori Black and me and Alexis Texas it’s clear to see that LA Direct is a star-creating foundation. There’s a generation that’s being created here and it’s really awesome.”

    Vivas Gives Princeton Anti-Porners a Piece of Her Mind

    PRINCETON, N.J.—Last month, a decision by Princeton University’s student government body (USG) to grant $1,500 to a student group called Let’s Talk Sex (LeTS), to be used for an event that would include the screening of clips from porn films, instigated a retaliatory effort by school feminists to stop the screening—even though it had not even been scheduled yet.

    Among the efforts was a petition that garnered several hundred signatures and an editorial by The Daily Princetonian, arguing against using school funds to screen “immoral” porn.

    Allison Vivas, president of Pink Visual, wrote an editorial in reaction to the campus controversy that was posted Friday to the school paper’s website. Needless to say, she took a position contrary to those expressed by the editorial writers.

    The editorial—'A porn executive and a feminist'—is reprinted here in its entirety:

    In reading The Daily Princetonian’s coverage of the event organized by the student group Let’s Talk Sex last month, I was struck by the fact that many of the students and alumni expressing opposition to the screening of pornography at the event have voiced their resistance with assertions that are built upon faulty assumptions and flawed axioms.

    In explaining her opposition to the screening portion of the event, Shivani Radhakrishnan ’11, president of the Anscombe Society and a member of the ‘Prince’ Editorial Board, asserted that “pornography portrays women as objects of sexual desire and normalizes this objectification,” and that “there are health costs [like] addiction.” Setting aside for the moment that the concept of “porn addiction” is a highly contested notion in scientific and medical circles, and that its validity as a bona fide addiction is far from a given, it is simply false to assert that all pornography portrays women as “objects of sexual desire.” The area in which this tired cliche is most obviously false is in the realm of gay pornography. Many gay pornographic films do not depict any women at all, much less depict them as objects of sexual desire.

    Limiting the scope of her claim to pornography that does depict women, this position still begs many questions: How do the works of lesbian pornographers who produce erotica featuring women and intended for viewing by other women fit into this axiom? Are these lesbian producers, directors and performers subject to the same bevy of demonizing assumptions as their male counterparts? Are they even worse in their exploitative wiles, given that they are targeting fellow females both in their visual exploitation and as the consumer audience for their films? Does the genre of “fem dom” pornography — in which a female figure is in control — fit into this maxim regarding objectification?

    As both a woman and president of an adult entertainment company, Pink Visual, I strongly object to feminists presuming to speak on my behalf when they rail against pornography. The very point of feminism is to affirm that women are fully formed human beings, capable of independent thought and action, and entitled to every bit as much diversity in their thinking and actions as are their male counterparts. I would love to see women who are anti-porn show greater consideration for the opinions and actions of women who are not anti-porn, and for those of us who work in the adult entertainment business, in particular.

    Women who are comfortable with pornography’s existence are not all damaged, mentally feeble victims of some male oppressor who sits behind the curtains, clandestinely pulling our strings. Some of us working in adult entertainment are doing precisely what we want to do — and doing it quite well! 

    Furthermore, at Pink Visual, women occupy the majority of the seats on our executive staff. Apart from me, our marketing director, chief financial officer, corporate counsel, brand and product manager, customer service director, and sales manager are all women. Have we all been co-opted by male oppressors? No. Is there any reason we should not be offended by that implication on the part of anti-porn feminists? I cannot think of a single one, frankly.

    Our company is not unique among adult entertainment companies in this regard: We are really just the tip of the iceberg. Take a look at this year’s nominees for the “Feminist Porn Awards.” I submit to you that the women represented on that list would, as I do, take umbrage with the suggestion that we are all exploiters of the female performers we employ. That assertion is not only unfair and ill-informed, but it is also deeply offensive to women on both sides of the camera.

    In fact, consumption of pornography by women is reportedly on the rise. While data obtained through surveys must always be taken with a grain of salt, the results of a survey conducted by Netmums and reported on by various media outlets indicating a marked increase in porn viewing among women in recent years is supported by data we’ve collected here at Pink Visual from our own customer base. More and more, we are seeing women joining our websites and buying our DVDs. Men still greatly outnumber women among our customers, but that margin is thinning decisively over time.

    The central thrust of my point is that it simply isn’t the place of anti-porn feminists, or any type of feminists, to speak on behalf of all women everywhere. To attempt to do so is equal parts presumptuous, egotistical and ignorant.

    I hope my perspective benefits your ongoing debate about the Let’s Talk Sex event and lends credence to the idea that not all women condemn any and all pornography as exploitative, ruinous and corrupting.

    CNN Gives Nod to Tech-Innovative Porn

    NEW YORK—The old saw that porn lives at the leading edge of technological innovation continues to work its magic on the mainstream, as evidenced by an article Friday on CNN.com titled “In the tech world, porn quietly leads the way.” While adult entertainment has been decrying its relative lack of innovative spice of late, this time the argument has some juice.

    The writer, Doug Gross, hit the salient points right off the bat. The release of the iPad, he said, has not only heralded a brave new world of “gaming, book and magazine reading and Web consumption,” but also much more. Porn was right there at launch, as well, streaming content directly to the new devices, “skipping the Apple store and its restrictions on salacious content.”

    In doing so, he adds, it immediately reinvigorated the “widely acknowledged but seldom-spoken truth of the technology world: Whenever there's a new content platform, the adult-entertainment industry is one of the first to adopt it—if they didn't help create it in the first place.”

    Adding meat to the bones of his argument, Gross cited two companies working hard to exploit technologies that have recently come into their own: cloud computing  and 3-D.

    Private Media Group has engaged the former for use with the iPad, as reported by AVN.com in early April.

    “Ilan Bunimovitz is the CEO of Private Media Group, the company that announced the iPad porn offering, which uses cloud computing to store a customer's videos,” wrote Gross. “In effect, he's saying it's like an iTunes for porn—an online service that lets users buy and access a personal collection of adult videos via their iPads. Of course, the slate computer's browser can already be used to surf the internet for adult content.”

    The other, One Dollar Production, based in Hong Kong, will start filing an adult movie in 3D in April that it has billed as the “world’s first 3-D erotic film,” complete with a reported $4 million budget. Depending on how one defines erotic, however, it is not quite accurate to say that this will be the first 3-D adult movie produced recently. Not by a long shot.

    In fact, as AVN Senior Editor Mark Kernes pointed out in a feature article on porn's 3D history and future, published in November 2009, the current resurgence of interest in 3D porn is nothing new. Every few decades, just as in the mainstream, adult becomes enthralled with the possibilities of 3D. With the release and subsequent success of Avatar, porn sat up and took notice, just like everyone else.

    Several studios have 3D movies in production, slated for imminent release, and a few have already been streeted, including last year’s interactive release, Tommy Gunn’s Cummin’ At You, and New Sensations’ Octopussy 3-D: A XXX Parody, the first straight adult feature in over a decade, which was released in April. In March, a gay movie, Whorrey Potter and the Sorcerer’s Balls, was released that made extensive use of “green-screen” special effects with adult 3D content.

    These examples only bolster the points made in the CNN article that the adult industry is serious about reclaiming its mantle as the go-to industry for the immediate adoption of new technology.

    For Ilan Bunimovitz, CEO of the aforementioned Private, being ready to launch when new technologies or tech-enabled devices roll out is not just desirable for adult companies, but obligatory.

    "Every step of the way, when there's a new technology, we explore it," he told CNN. "In the adult business, many times the traditional venues are not available to us, so we have to be innovative to get our content to the consumer.”

    That approach is all the more essential as adult entertainment continues to deal with the most serious economic downturn it has faced in decades, or maybe ever. While the global recession, a glut of free content, the scourge of piracy and a changing media environment take turns nipping at porn’s bottom line, the relentless advance of pioneering technologies is one of the areas that provides room for true optimism among not only porn’s ruling class, but also the unknown innovators who will surely make their entrepreneurial mark in the future.

     "There's always something new," added Bunimovitz. "At any point in time, we'll be working on new initiatives. Some of them will flop and some of them will be big—but there's always something in the works.

    VALLEY GLEN, Calif.—Taryn Thomas has found her raison d’etre.

    The Dirtiest Girl in Porn F.A.M.E. Award-winner inhabits the role of Snooki—that now famous-for-no-reason star of MTV’s cult phenomenon Jersey Shore—so naturally in her Taryn It Up Entertainment’s X-rated spoof of the show, it’s a little frightening. Then again, she by every right should take to it like a duck to water, being the purebred Jersey girl she is.

    On the day we visit the set of Jersey Shore XXX, a big dance club scene is being staged. The set dressing is impressive—there’s a mirror ball dangling from the ceiling, the bar is authentically stocked, the floor is dotted with large pink couches. And Taryn is totally in character.

    Upon mention that the real Snooki was spotted wearing a “Porn Star in Training” ball cap, Taryn blurts out in full-on Jersey drawl, “Snooki shouldn’t wear a ‘Porn Star in Training’ hat if she doesn’t want to be in training … you can’t do double anal, you don’t roll in my crew!”

    Before rolling (camera, that is), director Jim Enright points to a table in front of the couch where Taryn and Veronica Rayne will be sitting for the scene setup, and instructs Taryn, “Make sure there’s Sidekicks on the table and all that goofy crap girls can’t live without.”

    What’s being shot are “confessionals” by Snooki and “Woww-J” (Rayne) that will lead into a girl/girl scene between them.

    Rayne goes first, saying, “I’m not usually into girls, but there was definitely something going on between Snooki and me. How hot would it be to watch two Guidettes lick each other from head to toe?”

    Taryn follows that up with: “So the whole time I’ve been down at the Shore, I’ve been listening to Woww-J and Paulie D. get down in the room next to mine, so I figured I’d check her out and see how wild she really is.”

    For the actual scenario, a drunken Snooki stumbles over to Woww-J through the fist-pumping crowd and essentially attacks her. Woww pushes her off at first, but before very long, they’re making out hot and heavy. They then decide to ditch the club and head back to the house, away from, as Snooki puts it, “all these fucking Guidos” … but not before she punches one of them out. Again, Taryn carries it all out like second nature.

    Maybe MTV would like to focus on Ms. Thomas for season two of its reality show … call it Jersey Porn? How’s that for some crossover potential?

    Inability of company used by several adult affiliate programs to issue checks has left many affiliates holding bad checks or waiting for payouts that will be very late

    DoJ Apparently Freezes WebmasterChecks Bank Accounts

    SURPRISE, Ariz.—WebmasterChecks, an Arizona-based company that provides check printing, folding and mailing services for domestic and European companies, has apparently had its bank accounts frozen by the U.S. Department of Justice. In business since 2005, WebmasterChecks provides check payment services for a range of adult affiliate programs, including some significantly sized programs.

    Initial word that something was amiss with WebmasterChecks payments came via a Wednesday post around noon on GFY. The poster had received an email from an affiliate program warning him not to deposit a check he may have received from the check-issuing company.

    “"For anyone who receives their payouts in check/cheque,” the email reportedly read, “we would request that you do not try to deposit them. There appears to be an issue with WebmasterChecks and the US Dept of Justice. If you want faster payment, please send us your check/cheques and we will gladly send out hand written checks and or epassporte payments to all affiliates who cannot deposit their payments. We will certainly cover the fee for epassporte or any returned checks/cheques."

    AVN.com emailed and called WebmasterChecks for comment Wednesday afternoon, but received no reply to a message left at the company offices. At 5pm, however, WebmasterChecks posted the following message to GFY.

    “We very recently became aware of an issue regarding our bank accounts being frozen by the Department of Justice and our attorney’s are working diligently to resolve this issue immediately and correct the error in how the DOJ handled this issue. Unfortunately, the Agent in charge of the case, took this action and then went on Vacation. We believe this is not related to our business practices and, therefore, should not have impacted our valued clients.

    “We apologize for not informing you of this problem sooner, but we assumed that we would resolve this overnight as we would not have expected to have to wait for someone to return from Vacation. We are certain our business has all necessary licenses and registrations, has followed all rules and regulations to the best of our ability, and we know we will have a favorable resolution to this as soon as we have opportunity to speak with the case agent.

    “We, and our attorneys, are working as rapidly as possible to resolve this issue. We will work hand and hand with each of you and your affiliates to ensure that we resolve this matter in a timely manner, with as little impact as possible.
